This article presents a historical overview involving the Department of Homeland Security, the Cybersecurity and Infrastructure Security Agency, and the Commerce Clause, which outlines nationalization and its effects. It will note a similar trend for cybersecurity. Abstract:The United States is susceptible to cyberattacks. The Cyberspace Solarium Commission Report provides several recommendations to prevent and respond to such attacks. However, many of these recommendations attempt to nationalize cybersecurity. This article presents a historical overview involving the Department of Homeland Security, the Cybersecurity and Infrastructure Security Agency, and the Commerce Clause, which outlines nationalization and its effects.
