PENGATURAN ILLEGAL TRANSHIPMENT PADA ZONA EKONOMI EKSKLUSIF INDONESIA BERDASARKAN HUKUM INTERNASIONAL DAN HUKUM NASIONAL

Abstract

Illegal transhipment is an organized crime action who involve two or few other states. It does with removing fish load from local fisherman to the foreign ship in the other country’s waters which is unreported to the authorized party and directly go to their countrys to get a big profit and minimalize loss as small as possible. Furthermore, this act in the Indonesian’s exlusive economic zone doesn’t have the rules that arrange to this act for fines and imprisonment punishments. So that, this research aims to analyth some rules of law to get the answer does the recent law could be applied to the illegal transhipment perpetrators. This research methods using normative juridical which is regulatory approach methods or primary and secondary data that use some literature product of law and references which have been collected before. This result from this research that the rule of law which contains about the illegal transhipment haven’t been
