Droit étatique et processus de normalisation : quelles relations possibles en santé et sécurité au travail ?

Abstract

The legal sources of occupational health and safety law are divided between international law, European Union law, national law and conventional law resulting from social dialogue. Today, another development is strongly emerging in occupational health and safety management resulting from the emergence of a standardisation process generated by private bodies which are thus creating an increasingly influential extra-legal standard. The aim of this contribution is to study their scope and nature, but also whether there is a link with legal occupational health and safety standards and since the development of standardisation now seems ineluctable. The aim would not be to oppose them, but on the contrary to find a complementarity between them where this is justified and does not take precedence over legal standards in occupational health and safety.
