Abstract

Objectives: To analyze the high risk factors of obstetric brachial plexus palsy (OBPP), and to explore how to evaluate the relationship between fault medical behavior and OBPP in the process of medical damage forensic identification.

研究目的分析产科臂丛神经麻痹(OBPP)的高危因素,探讨在医疗损害司法鉴定过程中如何评价过错医疗行为与OBPP的关系:对北京市法源司法科学证据鉴定中心2017年至2021年25例与OBPP相关的医疗损害责任纠纷案件进行回顾性分析。总结了医院在出生体重评估、分娩方式选择、产程观察、肩难产处理等方面存在的不足,以及与患儿损害后果之间的因果关系:过错医疗行为被鉴定为主要原因2例,同等原因10例,次要原因8例,次要原因1例,无因果关系1例,因果关系不明确3例:在OBPP的司法鉴定过程中,应从产前评估、分娩方式告知、催产素的规范使用、肩难产的规范操作等方面客观分析医疗行为是否履行了诊疗义务。同时,要充分考虑不同危险因素的客观风险和伤害预防的难度,综合评价过错医疗行为在损害后果中的因果关系。
