在专利申请中披露原产国可能无助于保护遗传资源和传统知识
2024 年 5 月 24 日,世界知识产权组织通过了《知识产权、遗传资源及相关传统知识条约》(以下简称《条约》)。尽管该条约被誉为土著人民和地方社区的胜利1,2 ,但其效力将取决于各国法律如何执行该条约。该条约的基石是要求当发明基于遗传资源时,专利申请人必须披露这些资源的原产国,如果不知道,则必须披露来源国。当发明基于与遗传资源相关的传统知识时,申请人必须公开提供传统知识的土著人民或当地社区,如果来源不明,则必须公开来源。
