Baseball arbitration desde una perspectiva contractual

Abstract

Baseball arbitration is an alternative dispute resolution mechanism that allows a quick and economic solution of conflicts that, in addition, favors the conservation of the underlying relationship, because it forces the parties to be moderate. However, its implementation in Colombia has not yet been achieved, due to it cannot be done as arbitration o as amicable resolution dispute. Therefore, this article proposes an implementation structure in the country from an entirely contractual perspective, through the mandate, settlement agreement and other national legal institutions.
