Abstract

The Spanish model of impunity for crimes during the dictatorship, prototype of state crimes, is based on a preconstitutional law, the failure of politics due to the absence of transitional justice measures and the judges’ decision of denying access to justice for the victims. A framework that has been developed through the juridical ideology of oblivion and the denial of history. The article tries to explain the process of questioning the impunity of the francoist regime that resulted from the transition to democracy and the reasons that have put it in crisis
