Abstract

This work aims to study the water as a common good, since it is essential for human life. The research problem is summed up in the question: “Should water be seen as a common good, out of the traditional legal categories of public and private?”. The research has developed in three chapters: The first section explains the conception of common good in the Brazilian legal order; in the second section, was verified the legal treatment of water in the international law; in the third development section, it was reflected the water as a common good. The research was produced through a deductive approach method, a monographic procedure method and a documentary bibliographic research technique, since books, legal articles from scientific journals, constitutional and infra-institutional norms, Brazilian and international were verified. In general, only original papers will be considered. By virtue of submitting a manuscript to the journal, the authors attest that it has not been published or submitted simultaneously for publication elsewhere. However, papers previously presented in conference proceedings may be submitted in enhanced form. If a paper has appeared previously, in any form, the authors must clearly indicate this and provide an account of the differences between the previously appeared form and the submission.
