Abstract
No cabe duda de que la buena fe desempeña un papel fundamental en el derecho de contratos moderno; sin embargo, su campo de acción y por ende el papel del juez parecen variar según la apertura del sistema de fuentes del ordenamiento en que se pretende aplicar. Así, el ejemplo de las soluciones que se ofrecen frente al fenómeno de la excesiva onerosidad sobrevenida, y en particular en tiempos de pandemia, muestra cómo ellas varían de un ordenamiento a otro según la posibilidad del juez de recurrir a la equidad para fundar su decisión.

The Revista de Derecho Privado is a semi-annual publication that compiles the results of the investigative efforts, researches and articles written by professors and jurists from national and foreign universities, that are of interest to the legal community. The journal touches on subjects of private law, with special consideration to its development within the traditional roman domain, in order to make evident the contrasts and similarities between the Latin American and European legal systems, without overlooking, of course, the required confrontation, which today is a must, with the so-called the Anglo-American law.
