The article substantiates the expediency of the High Qualification Commission of Judges of Ukraine to conduct only interviews, testing of professional knowledge and skills, to consider issues of integrity, morality of candidates. Then form lists of those candidates who meet the requirements of current legislation on professionalism, morality, integrity, experience and qualifications. Then propose to hold elections of judges to the Supreme Anti-Corruption Court by the population of the country through electronic voting. An electronic identification of a person can be an electronic signature (for example, an electronic signature used to submit an electronic declaration of a person authorized to perform the functions of the state or local government). This will enable people to elect those judges whom they consider honest, impartial and professional. In addition, it would be appropriate to prescribe the procedure for recalling judges of the Anti-Corruption Court, if such a person has committed an offense. Normalization of such procedures requires amendments to the current legal documents of Ukraine. 摘要

本文分析了最高反腐败法院发展和运作的法律框架。该条证实了乌克兰法官高级资格委员会只进行面谈、测试专业知识和技能、审议候选人的廉正和道德问题的权宜性。然后列出符合现行立法在专业、道德、诚信、经验和资格方面要求的候选人名单。然后建议全国人民通过电子投票的方式选举最高反腐败法院的法官。个人的电子标识可以是电子签名(例如,用于提交被授权执行州或地方政府职能的人员的电子声明的电子签名)。这将使人民能够选出他们认为诚实、公正和专业的法官。此外,还应规定罢免反腐败法院法官的程序,如果此人犯了罪。要使这些程序正常化,就必须修正乌克兰目前的法律文件。研究报告指出,为了提高乌克兰最高反腐败法院的效力,应采取以下步骤:首先,应采用透明的制度任命乌克兰最高反腐败法院的法官及其对不合理决定的责任;第二,在乌克兰最高反腐败法院的活动中引入透明度;第三,确定乌克兰公民罢免法官的程序;第四,规定向乌克兰公民报告法官的程序。
