The research objective is to examine and analyze how natives' rights are construed legally on a national and international level, as well as how their protection can be used as a tool for participation in the enforcement of regional autonomy. It also aims to derive a conclusion regarding the role of natives’ rights in enforcing regional autonomy. Several methods such as statutory, conceptual, historical, case, and comparative approach are used in a form of normative legal research. 摘要

区域自治权是指地方行政机关代表中央政府对本地区的行政法规进行调整和监督,地方上级领导和人大及其地方干部是本地区行政法规的执行者。研究目的是考察和分析在国家和国际层面上如何对土著人民的权利进行法律解释,以及如何将其保护作为参与实施区域自治的工具。本文还旨在得出关于原住民权利在实施区域自治中的作用的结论。一些方法,如法定的,概念的,历史的,案例的,比较的方法被用于规范性法律研究的一种形式。结果表明:(1)国际与国际原住民法均适用原住民概念,且更侧重于国际法;(2)严格来说,国家法律文书并未对原住民的权利予以承认和规范,以支持原住民参与政府计划和项目的角色和文化存在;(3)原住民参与地方政府管理的程度尚不理想。包括承认习惯的政府组织结构。
