This research is used normative method with statute approach, conceptual approach and comparative approach. The results of this research are the rights of employee especially local staff are written under working agreements according to Indonesia labour law. The embassy legal standing as a party on the working agreement has fulfilled substantial element as a employer. 摘要

本研究的目的是了解员工的权利,特别是印尼公民在外国使领馆工作的当地工作人员,以及外国使领馆在劳资纠纷解决中的豁免权的存在。本研究采用规范性研究方法,包括法规研究方法、概念研究方法和比较研究方法。这项研究的结果是雇员的权利,特别是当地员工的权利是根据印度尼西亚劳动法写在工作协议下的。使馆作为工作协议当事人的法律地位已经履行了作为雇主的实质性要素。此外,关于在劳资纠纷中适用豁免,印度尼西亚法院的判决显示出从绝对豁免到相对豁免的变化。关键词:外交豁免权,大使馆,劳资纠纷,当地工作人员
