The main international documents to be explored are: American Convention on Human Rights (CAADH), Convention 169 of the International Labor Organization (ILO) and the United Nations Declaration on the Rights of Indigenous Peoples. The justification of this research is made in the Federal Constitution of 1988 that determines the commitment with the international sphere. Reaffirming it with normative effectiveness with the principle of the prevalence of human rights, in Article 4 II, in the federal relations of the country. And also with the provision of article 5 § 2, which establishes that rights and guarantees expressed in the constitution do not exclude others arising from the regime and principles adopted by it, or international treaties that are part of the domestic legal order.
