CONTEXTUALIZATION OF AL-MAQASID AL-KULLIYAT TO THE INDIVIDUAL, FAMILY, SOCIETY AND HUMANITY’S ASPECTS: AN ANALYSIS ON JAMALUDDIN ATHIYAH’S PERSPECTIVES

Knowledge is always been developed in order to answer the society’s questions which are gradually more complex. So is maqasid al-syariah which belongs to one of the theories that is continuesly developed by the experts. Jamaluddin ‘Athiyah is a contemporary expert on maqasid who also developed the theory of maqasid which has been built by the classical and early contemporer experts. This study uses qualitative approach with literary study as its kind. Data collected is analyzed by using content analysis technique. After collecting the data, it is found that the maqasid building that Jamaluddin ‘Athiyah formed is different to the previous thought. From the process of determinating  maqasid al-syariah, human’s mind contribution,  illah position on determining maqasid become interesting discussion in the theory of Jamaluddin Athiyah while in the end he initiated  24 maqasid from 4 previous maqasid to a frame he called as wiggle room/ area of analysis.
