This article discusses the definition, types and categories of ownership within muamalat framework according to the different perspectives of Muslim jurists as found in the literature. This will enable Muslims to make better-informed decisions while undertaking current muamalat transactions. The applications of ownership theory in relation to current muamalat practices will also be addressed. This article concludes that the ownership theory within muamalat framework has solid ground. However, due to the changing global landscape, fresh ijtihads and innovative approaches in dealing with contemporary muamalat practices are needed.

This study aimed to investigate the feasibility of tourism management that upholds halal values and meets maqāṣid al-sharī’ah indicators, without necessarily using a halal label. Specifically, it aimed to understand the community's social, economic, and religious dynamics where a tourist destination grows and is managed. Using an ethnographic approach, the study was conducted in 2022. Data were collected through semi-structured interviews with twenty informants, document analysis and observation. The Spradley model was employed to analyze the data. The findings of this study indicate that the management of Pantai Indah destination in Kerinci Regency emerged in a social context where religion and culture were closely intertwined through acculturation processes. Therefore, tourism in this area is a religious-cultural expression, rather than solely an economic pursuit. This background has allowed tourism to meet the elements of halal without requiring a halal label or special assistance, while still being able to initiate community-based tourism. Moreover, tourism can be measured using maqāṣid al-sharī’ah indicators. However, the study has certain limitations, such as the concentration of data in one community and the lack of comparison with other communities using different typologies, approaches, and characteristics. Nevertheless, this study recommends that the halal tourism program advocated by the government cannot be implemented in a top-down and uniform manner for all regions. This is because, in several areas, the local community has rejected such a program. In fact, halal tourism can be successfully implemented by ensuring its substance without the need for a halal label.

The research aims to highlight the legislative and ethical purposes that have been overlooked in the verses related to food. Scholars have focused their attention on discussing the rulings and etiquettes related to food, neglecting the extraction of legislative and ethical purposes embedded in these verses. This has had a significant negative impact on the interaction of Muslims with the verses concerning food in their religious and economic aspects. It has also facilitated the European Union in issuing its first approval from the health authority for the consumption of insects as an alternative food to halal food. This situation has led to this research being conducted to derive legislative and ethical purposes from the verses about food. The study aims to help Muslims and Westerners have a deeper understanding of the objectives and purposes behind these legislations, emphasizing the balance between legislative and ethical purposes in accordance with the principles and rules of Islamic law. The research employed an analytical approach to derive the purposes from a jurisprudential perspective. Several results were identified, the most significant of which is that highlighting the legislative and ethical purposes in the verses about food demonstrates the merit of preserving human life, unlike secular laws. The elements of generality, necessity, abandonment, coercion, and specificity in the verses about food are form some of the most important precepts. Ethical purposes complement legislative purposes in the verses about food, as to separate the rulings from ethics is to divest from the all-embracing context of the provisions of the Sharia. Ethical purposes take precedence over legislative purposes in terms of action and attention, as they represent a general purpose in Islamic law. ملخص البحث يهدف البحث إلى إبراز المقاصد التشريعية والأخلاقية التي غابتْ عن آيات الأطعمة، فقد تركز اهتمام العلماء حول مناقشة الأحكام والآداب المتعلقة بالأطعمة وأغفلوا تَثوير المقاصد التشريعية والأخلاقية، التي تحملها هذه الآيات. مما أدى إلى تأثير سلبي كبير على تفاعل المسلمين مع آيات الاطعمة في جوانب حياتهم الدينية، والاقتصادية، كما سهَّل أيضا للاتحاد الأوربي بإصدار أول موافقه من الهيئة الصحية باستهلاك الحشرات كغذاء بديل للطيبات الحلال. وهذا ما جعل الباحث يعمل جاهدا على استنباط المقاصد التشريعية والأخلاقية من آيات الأطعمة؛ لتساهما في مساعدة المسلمين والغربيين بفهمٍ أعمق حول الأهداف والغايات من وراء هذه التشريعات، ويبرز التوازن بين المقاصد التشريعية والأخلاقية بما يتوافق مع ضوابط وقواعد الشريعة الإسلامية. وقد اتَّبع الباحث المنهج التحليلي لاستنباط المقاصد من منظور أصولي. وقد توصل الباحث إلى عدة نتائج أهمها إثارة المقاصد التشريعية والأخلاقية في آيات الأطعمة أظهرتا جمال الذوق التشريعي في الحفاظ على الحياة الإنسانية بخلاف القوانين الوضعية. جانب العموم ووجوب الترك، والاضطرار، والتقيد والتفصيل في آيات الأطعمة تعتبر من أهم الأركان الرئيسية لاستنتاج المقاصد.

The nomenclature of a subject matter represents the inherent characteristics and attributes of an item. In the context of the food sector, there exists a strong correlation between the name and commercial impact of a particular product. The choice of the name of a product names is significant for purposes of branding and marketing. Nevertheless, some parties combine illegal and permissible elements in the process of choosing product names, such as “hotdog”, “beer”, and others. The combination of brand names for halal products has become a subject of contention among Muslim scholars and customers, due to the ambiguity surrounding their halal status. This study examines the legal and Islamic implications of associating a halal product with a name that imputes prohibited elements from the perspective of the evidences found in al-Quran and hadith and the country's halal regulatory framework and the Shariah as a whole. Library research and content analysis are employed as methodologies to obtain relevant information on the subject matter of this research. The results of this study indicate that the definition of halal, as outlined in the halal legislation of this country is limited and is only restricted to food ingredients, products and services. Further, there exists a loophole in the powers conferred upon the relevant agencies to ascertain the suitability of the nomenclature to be in accordance with the principles of the Shariah, thereby ensuring adherence to the concept of halalan tayyiban in its entirety for each halal product. Abstrak Nama melambangkan identiti sesuatu benda. Dalam industri makanan, hal ini sangat berkait rapat dengan pengaruh komersial bagi satu-satu produk. Berikutan itu, pemilihan nama produk penting bagi tujuan penjenamaan dan pemasaran. Walau bagaimanapun, terdapat pihak yang menggandingkan unsur-unsur haram dan halal dalam pemilihan nama produk seperti Hotdog, Beer dan sebagainya. Penggabungan nama seperti ini bagi produk halal menjadi pertikaian dalam kalangan ulama dan pengguna kerana mendatangkan kekeliruan terhadap status halalnya. Sehubungan dengan itu, kajian ini membahas status penamaan sesuatu produk halal yang digandingkan dengan nama yang mempunyai unsur haram dari perspektif kerangka nas al-Quran dan hadis, perundangan halal negara dan hukum Islam. Kajian kepustakaan dan analisis dokumen digunakan untuk mendapatkan maklumat kajian. Hasil kajian mendapati konsep halal yang ditakrifkan di bawah kerangka perundangan halal negara sangat terhad dan hanya terpakai kepada kandungan makanan, barangan atau perkhidmatan sahaja. Malahan terdapat juga kelompongan terhadap kuasa agensi yang berkaitan dalam memastikan penggunaan nama yang bersesuaian yang selari dengan prinsip syariah dalam menjamin pematuhan konsep halalan tayyiban secara kolektif bagi satu-satu produk halal.

The land reflects the identity and spirit of the nation that are ingrained in the life of the Talang Mamak indigenous community, in addition to serving as an economic resource. Change in land status has several implications for their relationship with the land and its management. The purpose of this study is to examine the position of land for the Talang Mamak indigenous people. In addition, it analyses the implications of changing the status of land from customary forest to national park forest. This qualitative study employs the sociological law research approach by looking into the legal facts of the indigenous society of Talang Mamak in light of their relationship, ownership, and management of land. The main finding of this study is that the value of that land, due to its significant meaning and position, cannot be isolated from the Talang Mamak indigenous people. Nevertheless, the change in land status has created gaps and limited rights in forest management, highlighting several implications for the identity of the Talang Mamak indigenous people.

This research aims to study Legal Regulation of Third Party Intervention before the Palestinian Administrative Courts. by exploring legislative gaps in Articles 30 and 31 of the Decree-Law on Palestinian Administrative Courts, No. 41 of 2020, and seeks to enhance them to ensure justice, equality, and the protection of human rights and freedoms. The research employs a descriptive, analytical, and comparative approach to analyze and compare the legislative texts concerning third-party intervention before administrative courts in Palestinian law with those in the legal systems of comparable countries. Specifically, the research addresses the topics of mandatory and voluntary intervention, including their respective requirements and procedures. The research concludes that there are several gaps and ambiguities concerning the legal regulation of third-party intervention before administrative courts, which leads to inconsistencies in judicial opinions and practices regarding this issue. Therefore, the study recommends amending this legislation to enhance matters related to third-party intervention through the review of legal systems of comparable countries and learning from their experiences. in addition to establishing clear criteria to differentiate between types of intervention and evaluating their impact on the case, thereby supporting a deep understanding of legal practices and providing a framework in Palestinian administrative law. ملخص البحث يهدف هذا البحث إلى دراسة التنظيم القانوني لتدخل الشخص الثالث أمام المحاكم الإدارية الفلسطينية، مستكشفاً الثغرات التشريعية في المادتين (30) و (31) من القرار بقانون بشأن المحاكم الإدارية الفلسطيني رقم (41) لسنة 2020، ويسعى إلى تحسينها لضمان العدالة والمساواة وحماية حقوق الانسان وحرياته، ويستخدم البحث منهجاً وصفياً تحليلياً مقارناً لتحليل ومقارنة النصوص التشريعية المتعلقة بتدخل الشخص الثالث أمام لمحاكم الإدارية في التشريع الفلسطيني مع النظم القانونية للمحاكم الإدارية في الدول المقارنة، من حيث تناول موضوعات التدخل الإلزامي والتدخل الطوعي، بما في ذلك شروطهما وإجراءاتهما، وتوصل البحث إلى وجود العديد من الثغرات والتساؤلات المتعلقة بالتنظيم القانوني لتدخل الشخص الثالث أمام المحاكم الإدارية، الأمر الذي يؤدي إلى وجود اختلافات في الآراء والممارسات القضائية بشأن هذا الموضوع، لذلك يوصي البحث بتعديل هذا التشريع لتحسين المسائل المتعلقة بتدخل الشخص الثالث من خلال مراجعة نظم دول مقارنة والتعلم من تجاربها، إلى جانب وضع معايير واضحة للتمييز بين أنواع التدخل وتقييم تأثيرها على الدعوى، دعمًا لفهم عميق للممارسات القانونية وتوفير إطار مرجعي في القانون الإداري الفلسطيني.

Data has become highly valuable in the era of digitalisation and is the main target of cybercriminals. Cybercriminals steal data by exploiting system vulnerabilities. The rise of catastrophic data breach incidents affects business operations, reputation and legal standing, leading to business disruptions, financial loss and reputation damage. These incidents have raised data security concerns. The frequent incident is partly due to insufficient security measures in place. This article employs doctrinal research focusing on legal principles based on legislation to analyse Malaysia’s legal framework for protecting personal data in Malaysia and a comparison with other jurisdictions, i.e. the European Union General Data Protection Regulation (GDPR), the Singapore Personal Data Protection Act 2012 and the China Personal Information Protection Law (PIPL). The findings show that Malaysia’s data protection laws fall short of the international norm in some areas. This article suggests that Malaysian policymakers may amend the Personal Data Protection Act 2010 to align with international data protection standards to strengthen data security measures in preventive, detective and responsive data breaches. Consequently, this article provides an analysis of data protection laws in Malaysia and compares them with other advanced jurisdictions. It offers valuable insights into the challenges and opportunities involved in safeguarding personal data, the legal framework, and organisational strategies related to data privacy and security.

The study aims to discuss the theory of social contract in Islamic constitutionalism and its impact on the political process through analyzing the relationship between the people, the ruler, and constitutional institutions. The study focuses on the value of the theory of the social contract as an Islamic constitutional foundation that creates a balance in the relationship between governing authorities and the people. The study followed a descriptive-analytical approach and arrived at several findings, including that the theory of social contract in Islamic constitutionalism is based on constitutional foundations and principles that contribute to achieving a balance in the relationship between the people and the ruler and regulating governance appropriately. It also preserves the people's constitutional rights in the political process and the constitutional system that organizes the political process, in addition to surpassing the dominance of private groups over the public. The study particularly emphasized the importance of the mutual relationship between the ruler and the people, which forms the basis of the social contract between them, to achieve a balance between civil society groups, governing authorities, and the people. In conclusion, the study serves as a contribution to understanding the theory of the social contract in Islamic constitutionalism and its impact on the political process. Aut dedere (extradition) is an erga omnes obligation towards the international community aimed at closing the gate of safe haven so that the international criminal will face the consequence of his heinous act directed at the international community from the requesting state. The term aut dedere has not been used in conventions or treaties until the eighteenth century. This paper examines the necessity of integrating the doctrine of 'aut dedere' (extradition) into International Aviation Conventions to combat civil aviation offenses and seeks to explore its treatment under Islamic law, and the potential for punishment for refusal to extradite offenders. Through doctrinal legal research, the paper reveals that while aut dedere is obligatory under conventional law, it lacks enforceability without associated punishments. Conversely, extradition under Islamic law is deemed mandatory due to its universal nature. The paper underscores the relevance of Islamic jurisprudence in modern international legal frameworks and recommends amendments to International Civil Aviation Organization conventions to enforce extradition provisions and recognize civil aviation crimes as international offences, consistent with Islamic legal principles.
