PEMALSUAN AKTA AUTENTIK YANG MELIBATKAN NOTARIS

Abstract

Kasus yang berhubungan dengan kejahatan atau tindak pidana seringkali dilakukan oleh notaris. Meskipun notaris ini diangkat oleh pemerintah sebagai pejabat umum, akan tetapi ada diantaraya yang terjerumus dalam perilaku yang berlawanan denan norma hukum  dank kode etik. Salah satu jenis tindak pidana yang terkadang mejerumuskan notaris adalah pemalsuan akta autentik. Kasus pemalsuan akta autentik ini terjadi akibat kecenderungan salah yang diikuti notaris, yakni kecenderungan mendapatkan penghasilan yang lebih besar dibandingkan kalau penghasilan itu diperoleh dengan cara yang normal.Kata kunci: notaris, profesi, pemalsuan, akta autentikCase which deals with crimes or criminal acts is often carried out by notaries. Although this notary is appointed by the government as a public official, there are some who fall into behavior that is contrary to legals norm and code of ethics. One of crimes that sometimes plunge the notary is falsification of authentic deeds. The case of falsifying this authentic deed was due to wrong tendency followed by the notary, namely the tendency to earn more income than the income was obtained in a normal way.Keywords: notary, profession, falsification, authentic deed
