Abstract

Abstrak Penelitian ini berjudul “Analisis Hukum Islam Terhadap Penjualan Tanah Wakaf Masjid (Studi Kasus di Masjid Silaturrahim Dames Desa Dames Damai Kecamatan Suralaga Kabupaten Lombok Timur)”. Metode yang digunakan yaitu kualitatif, Hasil penelitian ini 1). Praktik penjualan tanah wakaf masjid di Masjid Silaturrahim yang dilakukan masyarakat Desa Dames Damai Kecamatan Suralaga Kabupaten Lombok Timur berdasarkan keputusan musyawarah pengurus Masjid yang menetapkan tanah wakaf Masjid dijual kepada masyarakat dengan harga Rp. 20.000.000,- per-are. Akad jual beli terhadap tanah wakaf tersebut dilakukan sebagaimana jual beli tanah yang umum berlaku di masyarakat. Hasil penjualan tanah wakaf tersebut dipergunakan untuk membeli tanah sebagai lokasi pembangunan masjid yang baru. 2). Analisis hukum islam terhadap penjualan tanah wakaf masjid Silaturrahim di Desa Dames Damai secara hukum Islam belum sesuai berdasarkan pendapat madzhab Imam Syafi’i dan hadits Nabi yang diriwayatkan oleh Imam Bukhari dan Muslim atas dasar hukum tersebut bahwa menjual harta wakaf dilarang mutlak karena harta tersebut adalah hak Allah SWT. Meskipun diantara keempat madzhab ada yang membolehkan yaitu Imam Hanafi, Imam Hambali dan Imam Maliki mereka membolehkan untuk menjual atau mengganti harta wakaf dengan syarat harta tersebut tidak lagi mendatangkan manfaat. Maka, untuk kemaslahatan yang lebih besar, dengan itu masyarakat melalui pengurus Masjid menetapkan untuk menjual tanah wakaf Masjid tersebut yang hasil penjualannya dipergunakan untuk membeli tanah sebagai lokasi pembangunan Masjid.   Kata Kunci: Hukum, Wakaf, Masjid     Abstract This research is entitled "Analysis of Islamic Law Against the Sale of Mosque Waqf Land (Case Study at Silaturrahim Dames Mosque, Dames Damai Village, Suralaga District, East Lombok Regency)". The method used is qualitative, The results of this study 1). The practice of selling mosque waqf land at the Silaturrahim Mosque carried out by the people of Dames Damai Village, Suralaga District, East Lombok Regency based on the decision of the mosque management deliberation which determined that the mosque's waqf land was sold to the public at a price of Rp. 20,000,000,- per acre. The sale and purchase agreement for waqf land is carried out as is the sale and purchase of land that is generally applicable in the community. The proceeds from the sale of the waqf land were used to purchase land for the construction of a new mosque. 2). The analysis of Islamic law on the sale of waqf land at the Silaturrahim mosque in Dames Damai Village according to Islamic law is not appropriate based on the opinion of the Imam Shafi'i school and the hadith of the Prophet narrated by Imam Bukhari and Muslim on the basis of the law that selling waqf property is absolutely prohibited because the property is a right. Allah SWT. Although among the four schools of thought there are those that allow, namely Imam Hanafi, Imam Hambali and Imam Maliki they allow to sell or replace waqf property on the condition that the property no longer brings benefits. So, for the greater benefit, the community through the mosque management decided to sell the mosque's waqf land, the proceeds of which were used to buy land as a mosque construction site.   Keywords: Law, Waqf, Mosque
