Los privilegios de los acreedores involuntarios dentro del régimen concursal vigente a la luz del fallo ‘Institutos Médicos Antártida’ de la Corte Suprema de Justicia de la Nación

Abstract

: This paper addresses the problem that arose in the ruling of the Supreme Court of Justice of the Nation, “Institutos Médicos Antártida s/ bankruptcy s/ verification incident” of 2019, in which the judges of that court granted the actor a privilege outside the system regulated in the bankruptcy and bankruptcy law to a creditor verified as unsecured in the liquidation contest of said hospital. Thus declaring the unconstitutionality of the regime and taking refuge in indefinite concepts, such as the dignity of the human person, leaving aside the fine regulatory plexus on the matter. With the par-ticularity of having dictated, the same court only 5 months before the sentence “French Philanthropic Association [...] s/ bankruptcy s/ inc. credit verification by L.A.R. and others” in a case with multiple similarities, having resolved the constitutionality of the regime, the application of the rules on bankruptcy preferences and the non-granting of the privilege invoked by the plaintiff.
