Fidelidade conjugal e Heidegger: uma discussão jurisprudencial e doutrinária sob a hermenêutica filosófica

ResumoCuida-se de artigo que tem como problemática discutir a relação entre a hermenêutica filosófica de Martin Heidegger aplicada e o princípio da fidelidade conjugal do art. 1566 do Código Civil de 2002. Entende-se que Heidegger propõe um estudo do indivíduo na medida da sua essência, o que leva em consideração mais que o ente, desbrava-se o ser. O estudo do ser reside na dialética com a ontologia, fazendo com que se prestigie a peculiaridade de cada pessoa. Ao ser aplicado ao Direito pode-se discutir diversas problemáticas de ordem fundamental, entre elas a inflação dos direitos fundamentais, como resultado de uma necessidade social do desmembramento da Dignidade da Pessoa Humana. Outra discussão diz respeito à possibilidade da hermenêutica filosófica de Heidegger trazer uma solução efetiva para a efetividade dos direitos fundamentais. A análise destes temas leva a necessária discussão da relativização da aplicação do dispositivo cível acima que já não mais legitima a desimpedida intervenção Estatal na vida particular do ser, respeitando-se a boa- fé e os novos costumes sociais. A metodologia adotada cinge-se no desbravar de correntes doutrinárias, análise de artigos científicos, estudos jurisprudenciais e do próprio Direito.Palavras-chaves: Martin Heidegger; Dignidade da Pessoa Humana; Fidelidade Conjugal; Jurisprudência; Hermenêutica filosófica. AbstractThis article deals with an article that discusses the relationship between the applied philosophical hermeneutics of Martin Heidegger and the principle of marital fidelity in art. 1566 of the Civil Code of 2002. It is understood that Heidegger proposes a study of the individual in the measure of its essence, which takes into account more than the being, the being is explored. The study of being resides in the dialectics with ontology, making each person's peculiarity prestige. When applied to Law, several fundamental issues can be discussed, including the inflation of fundamental rights, as a result of a social need to dismember the Dignity of the Human Person. Another discussion concerns the possibility of Heidegger's philosophical hermeneutics bringing an effective solution to the effectiveness of fundamental rights. The analysis of these themes leads to the necessary discussion of the relativization of the application of the civil provision above, which no longer legitimizes the unimpeded State intervention in the private life of the being, respecting good faith and new social customs.
