The legalization of real right is one of the basic principles of the real right law, and it means the category of the real right is rule by the law, disallowing the party concerned to establish the real right of the new category freely. The purpose of establishing the legal principle of real right is to make real right demonstrated, thus insuring the real right to trade transparently and conveniently, but the legal principle of real right comes to a deadlock, and it is an obstacle to the development of social economy.Therefore, on the premise of perfecting praclamation system of real right, the legal principle of real right should be negated, to satisfy the effective demand of the social economic development.
