A Study on the Improvement of National Marine Pollution Response Policy according to Change of Marine Pollution Incident Trend 基于海洋污染事件趋势变化的国家海洋污染应对政策改进研究

우리나라 해양오염방제정책은 1995년 씨프린스호 기름유출사고와 2007년 허베이 스피리트호 기름유출사고 대응을 겪으며 체계화되었다. 그러나 2010년 미국에서 발생한 딥워터 호라이즌(Deepwater Horizon) 사고는 최근 해양오염사고 트렌드 변화에 따른 우리나라 해양오염방제 정책 개선 필요성을 일깨워 준 계기가 되었다. 미래에는 해양오염사고 발생 지역이 원해와 해중·해저로 확대되고, 경질유, 가스 및 위험·유해물질 등 해양오염물질 종류가 늘어날 것으로 보인다. 기후변화에 따른 극한기상 증가로 사고도 자주 발생할 것으로 보인다. 또한 자연재난이 해양오염사고와 합쳐진 복합재난이 임해산업단지에서 발생하고, 해양오염사고에 따른 생태적, 사회경제적 피해도 증가할 것이다. 그러나 국가 해양오염방제 정책은 업무 범위와 법제도, 장비 및 기술개발과 의사결정 지원체계 측면에서 긴급방제 및 해상 기름유출에 한정되어 있다. 해양오염방제 의사결정 과정에 민간 참여도 부족했다. 따라서 본 연구에서는 국가 해양오염방제 정책 개선 방안으로 5가지를 제안하였다. 첫째, 해양오염방제 업무 범위를 복합재난 대처, 새로운 오염물질 대응, 기후변화와 생태계 영향 요인 저감으로 확대한다. 둘째, 관련 법제도 개정사항으로 해양오염사고 대응을 위한 업무영역 및 해양경찰청의 역할과 임무를 확대한다. 셋째, 전천후 대응이 가능한 방제 장비 및 기술을 개발한다. 넷째, 생태계와 사회경제적 민감 자원 영향을 저감할 수 있도록 해양오염방제 의사결정 지원체계를 개선한다. 다섯째, 과학적 의사결정을 위한 민간 전문가 참여를 확대하고, 국내 해양오염방제 산업 육성을 위해 아시아 지역에 특화된 박람회나 국제학술대회를 개최하며, 이해관계자의 인식 증진을 위한 방제 정보를 공개한다.
我国的海洋污染防治政策经历了1995年“海洋王子”号泄油事故和2007年“河北精神”号泄油事故后系统化。但是,2010年在美国发生的深水地平线(Deepwater Horizon)事故让我们认识到,随着最近海洋污染事故趋势的变化,韩国有必要改善海洋污染防治政策。在未来,海洋污染事故发生地区将扩大到远海、海中、海底,轻质油、天然气及危险、有害物质等海洋污染物质种类也将增加。气候变化带来的极端气象增加,预计也会经常发生事故。另外,自然灾难和海洋污染事故结合在一起的复合灾难会在临海产业园区发生,海洋污染事故带来的生态、社会经济损失也会增加。但是,国家海洋污染防治政策在业务范围、法律制度、装备及技术开发和决策支援体系方面,仅限于紧急防治及海上原油泄漏。民间参与海洋污染防治议事决定过程也不足。因此,本研究提出了5个改善国家海洋污染防治政策的方案。一是将海洋污染防治工作范围扩大到应对复合灾难,应对新污染物质,减少气候变化和生态系统影响因素。第二,作为相关法律制度修改事项,扩大应对海洋污染事故的业务领域及海洋警察厅的作用和任务。第三,开发全天候应对的防治装备及技术。四是改善海洋污染防治决策支持体系,降低生态系统和社会经济敏感资源影响。第五,扩大民间专家参与科学决策;为培育国内海洋污染防治产业,举办亚洲地区特殊博览会或国际学术大会;为增进利害关系人的认识,公开防治信息。
