In the article, from the point of view of modern tendencies of development of Russian state and law, associated with the desire to ensure the continuity of the basic institutions of constitutional law in order to preserve its constitutional identity under conditions of negative influence of processes of globalization and formation of supranational bodies of judicial control, an attempt is made to examine the constitutional and legal aspect of the concept, the essence of this kind of continuity and the need to ensure the development of the main domestic state-legal institutions in pre-revolutionary, Soviet and modern stage of their development. Various points of researchers are analyzed concerning the transition state of the main public law institutions in the Russian Federation, as well as the need to reform them not only in accordance with the postulates of the concept of liberal democracy, but also - the fundamental constitutional goals and values, principles, moral guidelines of the Russian state.

Searching for the ways to incorporate the concept of constitution and its different aspects into the theory and practice of international law presents a one of the current dynamic trends in international legal research. A significant role of the arguments concerning the existence and functioning of international courts is a common feature of various views presented within the discussion of the constitutional dimension of international law. The article contains an overview of basic theoretical doctrines on those functions of international courts which acquire constitutional features.
