In the wake of the Mabo decision from Australia and the Delgamuukw decision from Canada, it is clear that Aboriginal Title to land can only be lost through cession by treaty, abandonment, conquest, or legitimate legislation of the Crown. What is less clear is the effect that legitimate Crown Grants and Certificates of Title (accompanied by parcel boundary surveys) have on claims to aboriginal servitudes. Such servitudes represent non-territorial aboriginal title, and are akin to easements in statute law. Some of the tension over title to, and use of land can be defused by using fuzzy theory to define zones of overlapping rights in land. Such a methodology is similar to the continuing use of general boundaries in which a feature (sometimes ambulatory) defines the spatial extent of a parcel, allows sites of spiritual significance (sometimes used only seasonally) to be defined, and has application to New Zealand and Australia. Waahi Tapu could be thus defined (if not demarcated), thus according with the prin...

Abstract Undergraduate surveying degrees at Australian universities are increasingly being offered in combination with degrees in related disciplines. This paper provides a factual report on the current availability of such courses and provides some discussion of the rationale for their implementation and their perceived merit.

This paper presents findings of a research project which investigated the granting of title in Communal Areas in Zimbabwe. The research took place between May and June 1996, and, very broadly, it considered the problematic interaction between customary African land tenure, and modem land management systems. The land issue is probably the most thorny with which the present Government of Zimbabwe has had to grapple in the sixteen post-independence years. This paper recognises the dilemmas and compromises inherent in granting individual titles in communal lands, it summarizes and comments on recommendations made by the Land Tenure Commission, and it attempts to clarify options for issuing a form of title in Communal Lands.

Abstract Part 1 briefly discusses the basics of land “the most important factor of production in an agrarian economy (the predominant characteristic of most developing countries)” and proceeds to a detailed review of the theoretical approaches to the process of land titling. Part 2 treats of land titling in practice in a differentiated sample of developing countries. It goes on to identify issues arising from land titling in developing countries in general and reaches conclusions as to the efficacy of the process.

Abstract In late 1994, the Board of Surveyors of NSW commissioned a study on the age profile of registered surveyors. The findings are reported. In the next 12 years, it is likely that around 40% of surveyors currently registered will retire or scale down their surveying activities. If numbers are to be maintained, registrations will need to exceed current levels. Other implications are discussed.

Abstract Since regaining independence in 1991 the massive job of resurveying all land boundaries in Latvia has almost been completed. All boundary corners are coordinated which allows easy integration of cadastral boundaries into Geographic Information Systems. This paper outlines the surveying process in Latvia today, as well as giving an historical overview which reveals why Latvia uses a coordinated cadastre.

Abstract This survey was a redefinition of the location of what is reputedly Australia's first passenger railway. It was constructed in 1836 and was powered by convicts from the nearby Port Arthur penal settlement. Surviving evidence includes sections of low embankment, building remains and an original intact sleeper.
