Preventive detention enables a person to be deprived of liberty, by executive determination, for the purposes of safeguarding national security or public order without that person being charged or brought to trial. This paper examines Article 9(1) of the International Covenant on Civil and Political Rights, 1966 to assess whether preventive detention is prohibited by the phrase 'arbitrary arrest and detention '. To analyse this Article, this paper uses a textual and structural analysis of the Article, as well as reference to the travaux preparatoires and case law of the Human Rights Committee. This paper argues that preventive detention is not explicitly prohibited by Article 9(1) ofthe International Covenant on Civil and Political Rights 1966. If preventive detention is 'arbitrary', within the wide interpretation of that term as argued in this paper, it will be a permissible deprivation of personal liberty under Article 9(1) of the International Covenant on Civil and Political Rights, 1966. Preventive detention will, however, always be considered 'arbitrary' if sajeguards for those arrested and detained are not complied with, in particular the right to judicial review of the lawfulness of detention.

The basic purpose of the Protocol is to prevent and combat trafficking, to protect and assist victims and to promote international cooperation. The protection of, and assistance to, victims is specified as a core purpose of the Protocol. The Protocol requires that particular attention be paid to combat and prevent trafficking in women and children, while maintaining the basic principle that all forms of trafficking should be covered by the Protocol. A definition of the term "trafficking in persons" is provided in the Protocol, as well as a number of mandatory requirements relating to protection of and assistance to trafficked persons that State Parties are obliged to fulfil. The savings clause in Article 14 ensures that the Protocol does not affect the rights, obligations and responsibilities of States and individuals under international law, including international humanitarian, human rights and refugee law.

The Boston University International Law Journal is publishing, for the first time, an English version of the 2004 Arab Charter on Human Rights. A very brief review of how the 2004 Arab Charter came into being introduces this English translation. The drafting history of the Arab Charter on Human Rights begins in 1960. In that year, members of the Union of Arab Lawyers (the oldest NGO in the Arab world) requested the League of Arab States (created in 1945) during their meeting in Damascus to adopt an Arab Convention on Human Rights. Eight years later, participants in the first meeting for Human Rights in the Arab world held in Beirut, asked the Arab Commission on Human Rights to prepare an Arab Charter on Human Rights. In 1994, the League of Arab States adopted the first version of the Arab Charter on Human Rights at its 50th anniversary. The adoption of the Charter symbolized the importance of respect for human rights both to the Arab world and the League. The League’s adoption of the Arab
