Is the Japanese Monarchy in Crisis Due to Its Gender Bias? 日本君主政体是否因性别偏见而陷入危机?

Japanese monarchical succession is restricted to male offspring of imperial lineage, with the order of succession being primogeniture. This rule is not written in the 1947 Constitution—which prohibits sex discrimination in Article 14—but rather in the Imperial House Law of 1947. Given the current gender composition of the imperial family, it is not difficult to imagine a future in which the existence of the imperial system is threatened by a lack of legitimate male heirs. The article takes this reality as its starting point and evaluates the divergent attitudes of fundamentalist, orthodox, and egalitarian monarchists towards male-line primogeniture and the case for a gender-neutral monarchy in Japan. The article advocates an egalitarian view of monarchy as being most consistent with international law, Japan’s 1947 Constitution, comparative practice in contemporary monarchies, and the historical record that includes eight Japanese empresses who ruled in their own right. The article then turns to consider the contemporary role of the Emperor. Although the Japanese monarchy is comparable to others due to its exclusively symbolic and religious nature, the article notes its uniquely gendered aspects, such as the lack of public involvement and visibility of female members of the imperial family. Politicians, however, are reluctant to amend the Imperial House Law, which presents a structural barrier to gender-neutral monarchy.

Gender and the Monarchy in Belgium: Succession and the Exercise of Constitutional and Symbolic Power 比利时的性别与君主政体:继承与宪法和象征权力的行使

This article explores the gendered dimensions of the Belgian monarchy by focusing on three distinct topics. First, the article addresses the matter of succession to the throne. In Belgium, the exclusion of women from succeeding to the monarchy came to an end in 1991, but the first female monarch has yet to ascend to the throne. Next, the article examines the gendered dimensions of the way in which Belgium’s recent monarchs have exercised their role. As the King’s political role is limited, this article also considers the symbolic role of the King, which carries over to his private and family life. After the crisis known as the “royal issue” in the early 1950s, there has been only one constitutional crisis in Belgium that directly involved the monarchy: the refusal of King Boudewijn (Baudouin/Baldwin) to assent to the law legalizing abortion in 1990. The refusal concerned not only the exercise of the constitutional role of the monarch, but also a key issue of the women’s movement, and this article examines the development and significance of this crisis. Finally, the article analyses the current controversy concerning the refusal of the former king, Albert II, to recognize an extramarital daughter. Men’s refusal to take on responsibility for (some of) the children they father is a classical theme of feminist indignation. Arguably, the former king’s attitude on this matter in his private and family life affects the symbolic power of the monarchy.

The Governor General in Australia and Gender Equality 澳大利亚总督与两性平等

This article takes the appointment and term in office of Governor General of Australia, Dame Quentin Bryce (2008-2014), as the basis for a discussion about the potential role of the Governor General in promoting progress on issues of gender equality and minority rights protections. The article adopts a multidisciplinary methodology, combining law and feminist political science to analyse different receptions of the post when it is occupied by men and women engaged in debates concerning different minority populations. It makes a brief comparison with the institution of the President of the Republic of Ireland as functionally equivalent to that of the Governor General, in their respective roles promoting national identity and unity. With this comparison in mind, the article contends that the Governor General’s constitutional mandate presents no barrier to the holder of the office advocating for gender equality and minority rights protection. In fact, such advocacy, as exemplified by Quentin Bryce’s controversial public support for marriage equality during her term in office, is desirable, because equality is a key normative element of modern democracy. The article then critiques—from the perspective of feminist institutionalism—the gendered nature of the office of Governor General and considers how the office can and may in future evolve away from its gendered foundation.

The main focus of this article is to analyse the Danish monarchy from a gender perspective. However, the article also provides a general analysis of the Danish monarchy, the formal and informal powers of the monarch and the modern legitimisation of the monarchy. The development of the Act on Succession to the Throne, finally leading to full gender equality in 2009, plays a central role in the article. The approach is primarily legal, with an interpretation of legal sources as its point of departure, but the article goes beyond this by analysing informal power, public expressions on the monarchy and gender by members of the royal house as well as present-day legitimisation of the monarchy. Moreover, it positions this analysis in the broader historical context.
