El objetivo de este artículo es analizar las sentencias emitidas por la Corte Constitucional, con el fin de extraer los derechos y las garantías de los trabajadores campesinos y rurales en Colombia. Para ello, se empleará una metodología con un enfoque cualitativo sobre las pronunciaciones de la Corte Constitucional que el autor considera imprescindibles para entender lo otorgado a este grupo de personas trabajadoras del campo, las cuales han sufrido a causa de la violencia de grupos al margen de la ley y de la desatención de diferentes Gobiernos; en consecuencia, su universo poblacional será el documental. En cuanto a los resultados, encontramos que algunos derechos constitucionales fueron tenidos en cuenta durante la redacción constitucional y su posterior evolución jurisprudencial como sujetos de especial protección, pero que a nivel del Derecho Internacional hay una desatención por parte del Estado. En conclusión, en el plano constitucional y jurisprudencial este grupo social tiene una serie de derechos que, si bien a nivel nacional son suficientes, no han sido totalmente protegidos por parte de las instituciones.

El avance de la tecnología con respecto a la inteligencia artificial (ia) ha llevado a la academia a cuestionar no solo cuán lejos puede llegar, sino también cuáles son los posibles efectos nocivos que puede traer a la humanidad, motivo por el cual, y ante la falta de regulación legal del asunto, la Presidencia de la República publicó el “Marco ético para la inteligencia artificial en Colombia” en atención a las dinámicas mundiales de la ia. Objetivo: establecer la necesidad de la implementación de un marco ético y legal obligatorio para la ia y los algoritmos en Colombia. Metodología: se lleva cabo el análisis de los diferentes casos internacionales en los que se han discutido problemas éticos y legales de la ia y los algoritmos, y se propone la necesidad de cambios a nivel legislativo para Colombia. Resultados: un mecanismo necesario para la regulación es acudir al Congreso de la República para que legisle acerca de los aspectos éticos y de responsabilidad de la ia y los algoritmos. Conclusiones: la importancia y la necesidad de regular aspectos como la ética y la responsabilidad de la ia y los algoritmos deben animar al Congreso a regular el asunto. De igual forma, en manos de las altas corporaciones judiciales de Colombia está la responsabilidad de crear reglas que permitan la comprensión y el manejo de los conflictos suscitados por la ia y los algoritmos.

La organización de la gobernanza de los asuntos exteriores en los distintos países revela diferencias en los enfoques de la regulación jurídica del estatuto, la competencia, la estructura y los principios de interacción de los órganos de gobernanza de los asuntos exteriores. Esto se debe principalmente a las peculiaridades de la forma de gobierno y del sistema estatal, a la práctica de la administración pública y a los objetivos actuales de la política exterior. Las ventajas y deficiencias de la organización de la gobernanza de los asuntos exteriores en diferentes países deberían ser una de las principales fuentes de optimización de la gobernanza de los asuntos exteriores de Ucrania. Por ello, el propósito de este artículo es analizar las ventajas e inconvenientes de los diferentes enfoques de la regulación jurídica de la gobernanza de los asuntos exteriores, determinar las características del estatuto jurídico de los sujetos de la gobernanza de los asuntos exteriores en diferentes países, así como fundamentar las áreas prioritarias para mejorar la organización de la gobernanza de los asuntos exteriores en Ucrania. Para ello se utilizan métodos dialécticos, jurídico-formales, jurídico-comparativos, sistémico-estructurales, lógico-semánticos y otros métodos científicos. La aplicación eficaz de la política exterior requiere una organización constructiva moderna de la gobernanza de los asuntos exteriores, que tenga en cuenta las peculiaridades del sistema estatal, los intereses de la política exterior y el potencial del Estado, así como las tendencias progresistas y la experiencia positiva de otros Estados.

Este estudio consistió en evaluar cómo, a través de la educación ambiental y el aprendizaje basado en proyectos (abp), se transforman los saberes locales rurales para la sensibilización y concientización de los estudiantes de grado sexto frente al cuidado y la sustentabilidad del recurso hídrico en la inspección en San Antonio (municipio de Anapoima, Cundinamarca). A partir de un enfoque cualitativo, con metodología de investigación-acción participativa, se identificaron las prácticas que ejercen los diecinueve estudiantes participantes de la Institución Educativa Rural San Antonio frente a los usos que a través del tiempo se les ha dado a las diferentes fuentes hídricas para la sostenibilidad de la población. Dicha información fue obtenida a partir de instrumentos de observación directa y técnicas basadas en la aplicación de un cuestionario con preguntas abiertas. Esta investigación presenta datos del trabajo en campo obtenidos a partir del análisis de tres categorías: percepción del recurso hídrico, saberes ancestrales rurales, y problemas de contaminación hídrica. Como conclusión, se tiene que la implementación de la estrategia de abp a través de la educación ambiental favoreció el proceso de enseñanza-aprendizaje, y fomentó en los estudiantes el liderazgo y la autonomía para aprender y proponer actividades de concientización y cuidado frente al recurso hídrico. A su vez, se creó una cultura de investigación en los estudiantes, quienes fueron los actores en la formulación de las preguntas-problema y la solución de estas generando cambios actitudinales.

Tema y alcance: el presente trabajo de investigación tiene como objetivo analizar la importancia del derecho laboral aplicado en Colombia, y cómo este ha tenido una repercusión de índole internacional. Se examina tanto su origen como su vinculación con el ordenamiento jurídico colombiano, teniendo en cuenta el cambio que trajo la Constitución de 1991 en este ámbito. Características: el trabajo comienza explorando los antecedentes de la investigación en el tema laboral en Colombia para luego profundizar en la estabilidad laboral reforzada, desde una perspectiva comparada. Se destaca la necesidad de que Colombia incorpore aún más los tratados internacionales en materia laboral, sin llegar a la tutela como mecanismo de protección. Hallazgos: a partir de la revisión de la literatura, se evidencia que Colombia tiene un largo camino por recorrer en cuanto a la incorporación de los tratados internacionales en materia laboral. No obstante, se recalca la importancia de no recurrir a la tutela como única forma de protección. Conclusiones: Colombia es un Estado social de derecho en constante crecimiento, y en este proceso es importante tener en cuenta la protección de los derechos laborales de las mujeres, quienes son sujetos de protección y deben gozar de sus derechos.

The article examines the doctrinal understanding of the concept of ‘communication’ in criminal procedural law. It was concluded that communication in the criminal process (criminal-procedural communication) is an end-to-end exchange of information, which is characteristic of the criminal-procedural communicative space of both law-making and law-enforcement spheres. In a broad sense, it consists in law enforcement (judicial, doctrinal) interpretation before, during and after the application of the criminal procedural norm. In a narrow sense, this is the exchange of procedurally significant information by the participants of criminal procedural activities between themselves and the court in connection with the progress of criminal proceedings. Such an exchange consists in the provision of information, joint participation in the conduct of procedural actions and their mutual perception of each other, which is implemented in the procedural forms provided for by law. It is noted that the implementation of criminal proceedings in the conditions of martial law in Ukraine reinforces the relevance of the problem of the victim’s communication. It also requires the creation of human rights sectoral mechanisms that would ensure the protection of the victim’s rights. In particular, regarding compensation for damage caused to him/her as a result of criminal offenses due to the conduct of military operations on the territory of Ukraine. It is emphasized that the reloading of the ‘image of the victim’ in criminal procedural law should take place on the basis of the victim-centered approach proposed by the Advisory Mission of the European Union in Ukraine.

Human rights protection in every society is a fundamental tool in the preservation and conservation of a demo- cratic society. It therefore becomes the responsibility of every state in ensuring that those constitutional values protecting its citizens should be respected without any instances of violations. This issue of protection has be- come more of a nightmare and frustrated as we always experience violations of fundamental human rights of people, in which the case of Ukraine is not an exception with the presence of martial law. This article articulates that it becomes the place of the state of Ukraine in ensuring that those constitutional bases of human rights freedoms should be respected without any aspect of violation and restriction. For the situation is complex and questionable when there is continuous violation of human rights and freedoms with the constitutional bases restricting violations. In answering the various worries and controversies surrounding the protection of human rights in Ukraine under the martial law system, it will be proper for us in adopting a philosophical method so as in determining the rationale and the reasons behind aspect of restricting human rights and freedoms under the martial law in Ukraine. From the above explanation, the rule remains that the present of the martial law in Ukraine is more a curse than a blessing as human rights violations continue to be on the increase defeating the original intention of the law being that of the conservation and preservation of all human rights values and dignities in the country. This is really frustrating and embarrassing as human values are rather degrading and pathetic instead of the expectations and standards stipulated by the law of the country. It is really an aspect of disappointment.

The purpose of the research is to study the interaction of law enforcement bodies during the investigation of criminal offenses in accordance with international standards. The main areas of cooperation between law enforcement bodies in different states during the investigation of criminal offenses are highlighted. Recently, taking into account the great public danger of criminal offenses, it is worth noting that they have long acquired a transnational nature, and it is worth focusing special attention on the issue of cooperation between the National Police of Ukraine and international organizations on investigation of this category of criminal offenses. The methodological basis of the research is presented as comparative-legal and systematic analysis, formal-legal method, interpretation method, hermeneutic method, as well as methods of analysis and synthesis. Attention is drawn to the issue of cooperation between operational units of the National Police dealing in combating criminal offenses, and to the issue of foreign law enforcement bodies performing operational and investigative activities.

This article examines, and thoroughly analyzes, the key elements of the current state of national security processes in Ukraine. Also, ways of possible improvement of the state of ensuring the national security of Ukraine in the modern conditions of the active operation of the martial law regime are considered. It is noted that different countries of the world, at their own discretion, tend to interpret the essence and important elements of national security that exist in the world today. In addition, countries have different opportunities to take real action in relation to reforming the situation with their national security. The article focuses on the fact that truly high-quality and dynamic development of the sphere of proper provision of national security occurs in the state only when it is under threat (its state sovereignty, territorial integrity, or other important interests). The example of Israel, the United States and some other countries is not the only one where only after the emergence of this or that danger, the mechanisms and tools to overcome it begin to work in practice. Also, the importance of achieving Ukraine’s full membership in the NATO military and political alliance was emphasized. After all, this military and political alliance, which unites about three dozen sovereign states, the majority of which are true liberal democracies with real rule of law and a transparent and effective state system, is recognized as the best example of such a defense alliance in history of humanity and is a good association of states close to Ukraine in spirit. It is indicated that after repelling the Russian invasion, Ukraine should focus all efforts on joining NATO.

The research is devoted to the coverage of international legal acts and standards in European and international practice for the provision of public services as a direction of reforming legal education in Ukraine. Review of materials and methods is performed on the basis of analyzing documentary materials on regulation of the ser-vice legal relations. The directions of improving domestic legislation on the provision of public services taking into account international legal standards are proposed: 1) the development of the theory of public services, which consists in consolidating conceptual and categorical provisions in the concept of public services, prin-ciples of public services, quality criteria for the provision of public services, etc.; 2) unification of the legal re-gulation of administrative procedures by adopting the Administrative Procedure Code of Ukraine, which would clearly disclose the issue of providing public services; 3) fixing in the legal acts the types of legal guarantees to ensure the legality of the provision of public services: monitoring the activities of public administration entities on the provision of public services; 4) holding public servants accountable for refusing to provide a certain type of public service; 5) bringing into line with European experience the requirements for adoption, amendment, cancellation, and the possibility of appealing individual administrative acts that are the results of the provision of public services; vi) decentralization of power, which consists in justifying an increase in the powers of local authorities in comparison with public authorities.
