El objetivo de este artículo es analizar la recepción y aplicación del derecho al olvido en Brasil. Se hará un análisis de la colisión de derechos fundamentales, con base en el análisis de la doctrina nacional y de la jurisprudencia constitucional emanada del Supremo Tribunal Federal, del Superior Tribunal de Justicia, del caso que dio origen a la discusión del derecho al olvido y de casos recientes discutidos en tribunales extranjeros sobre el derecho a la privacidad, la vida privada y el derecho a la inviolabilidad de todas las formas de comunicación privada.

Today’s world faces a paradox: on the one hand thedevelopment of technology allows greater access, verification and disclosure of information, essential in a democracy; and on the other hand,there is a proliferation of fake news, an effort to capture public opinionprimarily for political and economic purposes.This paper refers to the impact of disinformation on society and theconflict of rights it creates. Concern about the negative consequences itproduces are explored, as well as the responses that have been given atinternational, regional and individual levels by some States.

Thirty years after the General Code of Procedure (C.G.P)came in force, this paper addresses the issue related to one of the mostsevere sanctions in our procedural system, regarding the consequencesset forth in art. 340 of the C.G.P for cases of unjustified default of theparties to the preliminary hearing. In this respect, art. 340 of the C.G.Pis analyzed from a constitutional point of view in regard to the withdrawalof plaintiff´s claim and the lack of legal assistance at the preliminaryhearing, as well as the provisions that establish the application ofconsequences provided for the aforementioned article for other procedural structures.

La negociacion colectiva en el sector publico presentaciertas particularidades derivadas del caracter estatal de una de laspartes. En efecto, el Estado se encuentra acotado en su capacidad denegociacion por el marco presupuestal que le otorgan las normas, lo cualmarcara la tonica de la negociacion y ejecucion de los acuerdos. En estecontexto, es necesario preguntarse si el Estado incurre en responsabilidad cuando por dichas particularidades incumple con los conveniosalcanzados y asimismo, si es susceptible de incurrir en responsabilidadprecontractual por la conducta que adopte en el marco de la negociacion.

“Crimes against Humanity”, as guarantees of humanrights, were established in international documents such as the“Statute of the International Military Tribunal of Nuremberg”, the“Convention against Torture and other cruel, inhuman or degrading treatment or punishment”, the “Inter-American Convention on Forced Disappearance of Persons”, the “Convention on the NonApplicability of Statutory Limitations to War Crimes and Crimesagainst Humanity”, and the “Rome Statute of the InternationalCriminal Court”, all ratified by Uruguay. Nonetheless, once the lastde facto government had ended (June 27th, 1973 to March 1st, 1985),Law No. 15.848, known as Law on the Expiration of the PunitiveClaims of the State, came into force and protected those who hadcommitted “crimes against humanity”during the dictatorial government. The Inter-American Court of Human Rights annulled thisamnesty law in the “Gelman vs. Uruguay” trial, and the UruguayanParliament complied with the judgment of the Court by enactingLaw No. 18.831. However, the Supreme Court of Justice declaredLaw No. 18.831 to be unconstitutional, basing its decision on thestatute of limitations and on the principle of non-retroactivity ofcriminal law. It is the purpose of this paper to analyze the transformations that must occur in order to end impunity.

New dimensions of fundamental human right to health, including palliative care, represent an important challenge for States within the framework of obligations undertaken regarding health issues. Palliative care focus on the person, must be interdisciplinary rendered by means of comprehensive health services in all levels of care, must serve limiting, chronic and incurable diseases as may be required, and must be provided to patients covering the entire age range. Constraints of diverse nature may be identified upon exercising the right to palliative care, including but not limited to deficiency or lack of specialized human resources and appropriate material resources at country level, as well as lack of appropriate information to the population with regards to the scope of this dimension of the right to health and the right to access thereof.

At Local Governments’ level, Uruguay’s Constitution states two mechanisms for direct participation, namely: referendum and popular initiative. Until 2013, the Electoral Board’s case law had denied the existence of such institutes, arguing that they required to be regulated by the lawmaker. Current case law of such Board, however, enshrines the existence of both institutes, although with serious limitations that, to the author’s view, violate the constitutional text, and that are analyzed throughout this paper.

On the basis of a journalistic report made to one of the precandidates to the Presidency of the Republic, in the elections to be held in 2019, we analyze the constitutional tool of Laws that have a declaration of urgent consideration by the Executive Power, for the purposes to expose, from a ‘Loewenstenian’ perspective, the effective limits that the Constitution establishes to the Executive Power for the exercise of this declaratory power, particularly, as for the possible content of these Laws and their necessary relationship with an urgent or critical situation.

Throughout this paper it is analyzed whether, according to the new Code of Criminal Procedure, in force since 2017, Prosecutors may have access to people’s health data. For this purpose, the characterization of this type of information will be developed from the perspective of protecting the right to privacy and professional secrecy.
