Racialization of Serious Crime Arrestees: Who Does It and Does It Predict Worry about Victimization in Minority Neighborhoods? 严重犯罪被捕者的种族化:是谁造成的?种族化是否预示着少数族裔社区对受害的担忧?

Abstract Using data from two statewide surveys conducted in 2018 and 2020, this study explores the characteristics of adults who racialize serious crime arrestees and examines if racialization influences worry of victimization in minority neighborhoods. Results show a significant increase in perceptions of Whites as the largest portion of arrestees, suggesting a reduction in racialization. Those who do racialize serious crime arrestees were significantly more likely to express worry of victimization in predominantly Black or Hispanic neighborhoods. Our findings suggest the public lacks accurate information about arrests for serious crimes which may perpetuate stereotypes about minorities.

Differential Prediction by Race in IRAS-PAT Assessments: An Application of Debiasing Strategies 种族差异预测在IRAS-PAT评估中的应用:去偏策略

Abstract There remain serious concerns about the potential for pretrial risk assessments to exacerbate racial disparities. Yet, current evidence on differential prediction in pretrial risk assessments is limited. The present investigation tests for differential prediction by race as an indication of bias in Indiana Risk Assessment System–Pretrial Assessment Tool (IRAS-PAT) assessments. Using pooled data drawn from a five-county IRAS-PAT validation, which included 689 Black and 2,850 White defendants, we primarily used a hierarchical regression-based approach to test between-group differences in the slopes of regression lines. Where slope-based bias was present, differential prediction was reevaluated once algorithmic corrections were applied. Findings showed IRAS-PAT assessments produced less accurate predictions of pretrial misconduct for Black defendants relative to White defendants. Only one debiasing strategy—which accounted for item-level differences across subgroups—corrected differential prediction. Debiasing strategies can mitigate differential prediction but may have limited utility for local jurisdictions under current legal frameworks.

Combatting Misinformation and the Assault on Academic Freedom with Research, Education, and Advocacy 通过研究、教育和宣传打击错误信息和对学术自由的攻击

Abstract In the wake of the social justice movements experienced across the nation, a coordinated legislative campaign has been initiated to limit how topics related to race, racism, and gender can be discussed, taught, and researched within primary, secondary, and post-secondary education. Not only do these efforts reflect a serious attack on academic freedom, they threaten the principles of our democracy. In this address, I present a summary of the most recent legislative proposals introduced at the state and federal levels, and discuss the impact they have begun to have on faculty’s ability to teach and to conduct research, as well as on university budgets. To counter this assault, I call for a collective response from faculty, students, administrators, and professional associations.

Abstract While body-worn cameras (BWCs) are increasingly becoming commonplace in police organizations, researchers and policymakers still know little about their implementation in the field and the factors related to their actual use. Using data collected from 146,601 incidents in Phoenix, Arizona, the present study examines the prevalence and correlates of BWC activation. In doing so, we examine the impact of incident-level factors, officer characteristics, neighborhood context, and changes in BWC activation policy on whether an officer who is assigned to wear a BWC activates their camera during a police-citizen contact. Cross-classified models are used to simultaneously assess the influence of factors at multiple levels of explanation. Our analysis suggests that a wide variety of individual, situational, organizational, and neighborhood factors are related to an officer’s decision to activate their camera. BWC policy that confines, structures, and checks officer activation has a robust impact on an officer’s decision to activate their BWC.

Driving Public Support: Support for a Law is Higher When the Law is Named After a Victim 推动公众支持:当法律以受害者的名字命名时,对法律的支持更高

ABSTRACT Despite the potential symbolic, political, and practical importance of naming a law after a victim, it is unclear whether this practice influences public opinion about the law itself. I conducted a randomized vignette survey experiment on 1,000 American adults to determine if support for a proposed distracted driving law, and the punishment it authorized, was influenced by whether it was named after a victim, as well as the victim’s race, gender, and age. I found that naming a law after a victim increased support for the law and the punishment authorized overall, but this effect was not consistent across all named laws, and instead was driven by specific types of named victims. In particular, results suggest the image of the “ideal victim” may have shifted or expanded to place greater emphasis on African American women, and less emphasis on White women.

Examining Cumulative Disadvantage against American Indian Defendants in Federal Courts 在联邦法院审查美国印第安人被告的累积劣势

Abstract Sentencing scholars have recently analyzed cumulative disadvantage that minority defendants are confronted with in the criminal justice system. This research has particularly focused on black, Latino, and to a lesser extent, Asian defendants. Little attention, however, has been paid to how American Indian defendants are treated across multiple decision points and cumulative disadvantage they endure. To address this gap, we use the Federal Justice Statistics Program data and assess whether American Indians, in comparison to other racial and ethnic groups, were more likely to face disadvantage at different stages in criminal case-processing. Findings indicate that American Indians are, in fact, more likely to experience cumulative disadvantage at different stages in federal courts. Implications for theory, policy, and future research are discussed.

Ethnic Diversity, Ethnic Polarization, and Incarceration Rates: A Cross-National Study 种族多样性、种族两极分化与监禁率:一项跨民族研究

Abstract Recent political rhetoric both in the U.S. and abroad has drawn renewed attention to racial and ethnic conflict, state power, and punishment. The salience of minority group conflict on incarceration is well established in theory and research in the U.S. This study explores whether racial/ethnic composition explains incarceration rates throughout the world, rather than being a peculiarity of the U.S. It also evaluates the functional form of these relationships. Analysis of up to 132 nations indicates that incarceration rates are significantly associated with ethnic diversity and ethnic polarization. The lowest incarceration rates are observed in countries with substantial homogeneity or substantial diversity. Incarceration rates are highest in countries with moderate diversity but high polarization—where a sizable minority population is present, approaching parity with a majority group. Minority group conflict may be a troublesome contributor to punishment throughout the world and is not a uniquely American phenomenon.

Abstract Much of the political rhetoric that facilitated mass incarceration was predicated on the promise of reducing fear among the public. Yet, it remains unclear whether the large increases in imprisonment experienced in many areas made residents feel less afraid. We examine this issue by integrating geographic data on imprisonment with individual-level data on fear from the General Social Survey (GSS). We find that people from states and counties with greater “cumulative imprisonment” rates were no less afraid than their counterparts from areas that imprisoned many fewer people. These findings hold for the public overall and for non-Latino whites and members of the working and middle classes, who frequently were target audiences for political rhetoric linking mass incarceration era policies to fear reduction. Our study supports growing calls to decouple crime and criminal justice policy from politics and electoral cycles, and to develop evidence-based punishment approaches organized around transparent normative principles.

What is the Value of Judicial Experience? Exploring Judge Trajectories Using Longitudinal Data 司法经验的价值是什么?利用纵向数据探索法官轨迹

Abstract Judicial experience is considered essential for the proper functioning of the sentencing system. We investigate how it influences judicial decisions and its role in reducing sentencing disparity. To do so, we analyze all Czech criminal decisions imposed in 2007–2017 using data that includes judge identifiers. This unique feature of our data enables us to measure judges’ experience directly, as the number of criminal cases processed, and to assess patterns in between-judge disparities longitudinally over the course of judges’ careers. We find that experienced judges impose more prison sentences, decide fewer cases via shortened procedure and find fewer defendants guilty. In addition, as judges become more experienced, between-judge disparities reduce across all the outcomes considered. Experience is thus an instrumental factor affecting judicial decisions throughout the criminal process, and one that contributes to greater consistency.

Explaining the Use of Traditional Law Enforcement Responses to Human Trafficking Concerns in Illicit Massage Businesses 解释在非法按摩业中使用传统执法措施处理人口贩运问题

Abstract Traditional police tactics such as rapid response and reactive enforcement continue to dominate the police response against human trafficking despite knowledge about the challenges and potential harm of using these tactics. Through the case of illicit massage businesses (IMBs), this study examines why police continue to rely on strategies that have received little empirical support. In-depth interviews with police, prosecutors, and other practitioners indicate that citizen concerns about human trafficking trigger police responses such as reactive investigations, sting operations, and shutdowns of IMBs. While law enforcement officials recognize the limited effectiveness and potential harm of the current response, adapting how police respond to IMBs is challenged by perceptual and institutional barriers. With these findings, the study contributes to the research and theory on traditional policing and informs targeted and victim-centered anti-trafficking efforts.
