The member States of the Council of Europe, signatory to this Protocol to the Convention for the Protection of Human Rights and Fundamental Freedoms, signed at Rome on 4 November 1950 (hereinafter referred to as "the Convention"), Considering that the evolution that has occurred in several member States of the Council of Europe expresses a general tendency in favour of abolition of the death penalty, Have agreed as follows: Article 1 – Abolition of the death penalty The death penalty shall be abolished. No-one shall be condemned to such penalty or executed. Article 2 – Death penalty in time of war A State may make provision in its law for the death penalty in respect of acts committed in time of war or of imminent threat of war; such penalty shall be applied only in the instances laid down in the law and in accordance with its provisions. The State shall communicate to the Secretary General of the Council of Europe the relevant provisions of that law. Article 3 – Prohibition of derogations No derogation from the provisions of this Protocol shall be made under Article 15 of the Convention. Article 4 – Prohibition of reservations (1)

"The Lund Recommendations on the Effective Participation of National Minorities in Public Life" were published in 1999 by the Foundation on InterEthnic Relations. They were developed by 18 experts on international law, political science and sociology illustrating ways to improve participation of national minorities in public life and hence strengthen domestic stability in states with minority populations as well as international security in general. It is certain these Recommendations will not fail to gain the attention of other experts in the field. Its authors are leading authorities on minority problems, who have incorporated their experiences from many different parts of the world in this document. They represent the current position on what is "feasible" in implementing contemporary policies for minorities. However this alone does not justify reporting on the recommendations of a non-governmental organization (NGO) in the OSCE Yearbook. There are much better reasons for pursuing this endeavour. For one thing the "Foundation on InterEthnic Relations" was created in 1993 as an NGO whose sole task was to support the OSCE High Commissioner on National Minorities (HCNM). This meant they had close links with his office, in other words, an OSCE body. A second point is that the HCNM commissioned the experts with the development of the Lund Recommendations personally. He was continuing a practice he had started in 1996 with the "The Hague Recommendations Regarding the Education Rights of National Minorities" followed by the "Oslo Recommendations Regarding the Linguistic Rights of National Minorities" in 1998.

Pada dasarnya anak merupakan subyek hukum yang harus dilindungi. Hal ini demikian adanya karena berdasarkan ketentuan hukum internasional dan nasional negara-negara di dunia, anak rnemiliki eksepsi tertentu di hadapan hukum.2 Eksepsi tersebut berupa pengecualian atas ketentuan hukum dalam berbagai niacam hal. Dalam hal ini, siapa pun yang termasuk dalam kategori anak, dapat dikatakan tidak cakap di hadapan hukum. Akibatnya, manakala seorang anak melakukan tindakan hukum tertentu, tindakannya tidak dikategorikan sebagai tindakan yang sah. Dala'ni melaksanakan suatu tindakan hukum tertentu, seorang anak diwajibkan untuk didampmgi oleh subyek hukum yang sudah cakap sehingga dapat menjadi wati dari anak tersebut. Selain itu, berdasarkan cabang keilmuan lainnya, anak-anak merupakan golongan yang masih menjalani pertunibuhan, baik secara fisik maupun psikis. Pertumbuhan tersebut perlu dilindungi dan dtjaga sehingga anak-anak dapat turnbuh dengan baik. Berangkat dari pola pikir demikian, posisi anak dalam dunia kerja (sebagai buruh) perlu inendapatkan perlindungan.

The present article aims to discuss the institute of reservations, by giving a general overview and discussing further the aspect of reservations on human right treaties. Besides that, it analyzes the Brazilian reservation at the Protocol to the American Convention on Human Rights to Abolish the Death Penalty, in this matter, tries to understand the settings that led the country to make such reservation and how it fits in the present environment. After going over some important international documentation, such as United Nations Resolutions and the Rome Statute, it concludes that this specific reservation has become obsolete.
