Abstrak Kajian ini membahas tentang aturan poligami di dalam atran Undang-Undang No.1 Tahun 1974 tentang Perkawinan. Fokus kajian dalam tulisan yaitu tentang alasan, tujuan dan tingkat ketercapain aturan poligami setelah disahkan dan diberlakukan di Indonesia. Poligami menjadi isu yang selalu diperdebatan dari masa ke-masa. Poligami di Indonesia sudah dilakukan sejak sebelum Indonesia merdeka. Hal ini disebabkan tidak adanya aturan secara tegas yang mengatur tentang perkawinan di Indonesia. Poligami yang dilakukan secara sewenang-wenang menjadikan hak-hak perempuan menjadi terdiskriminasi dan menjadikan anak-anak dan isteri terlantar. Tulisan ini merupakan tulisan hukum normatif dengan pendekatan yang digunakan yaitu pendekatan historis untuk mengetahui nilai-nilai sejarah yang menjadi latar belakang terbentuknya aturan Undang-Undang perkawinan. Sehingga dengan mengetahui latar belakang atau alasan dibuatnya aturan tentang poligami diharapkan dapat meminimalisir kasus-kasus yang terjadi dalam keluarga dan salah satunya yaitu poligami. Tulisan ini menggunakan teori perlindungan hukum dengan tujuan dapat menjawab rumusan masalah berupa tujuan dari adanya aturan poligami. Dengan adanya aturan tentang poligami dalam Undang-Undang perkawinan diharapkan dapat meningkatkan status wanita dengan melindungi hak-hak isteri dalam keluarga. Selain itu untuk mempertegas aturan poligami sehingga poligami tidak dilaksanakan secara sewenang-wenang. Kata Kunci : Aturan, Poligami, Tujuan. AbstracThis study discusses the rules of polygamy in the rules of Law No. 1 of 1974 concerning Marriage. The focus of the study in writing is about the reasons, objectives and the level of achievement of the rules of polygamy after being passed and enforced in Indonesia. Polygamy is an issue that has always been debated from time to time. Polygamy in Indonesia has been carried out since before Indonesia's independence. This is due to the absence of explicit rules governing marriage in Indonesia. Polygamy which is carried out arbitrarily makes women's rights discriminated and leaves children and wives neglected. This paper is a normative legal writing with the approach used, namely the historical approach to find out the historical values that are the background of the formation of the marriage law rules. So that by knowing the background or reasons for making rules about polygamy is expected to minimize the cases that occur in the family and one of them is polygamy. This paper uses the theory of legal protection with the aim of answering the formulation of the problem in the form of the objective of the existence of polygamy rules. With the existence of regulations on polygamy in the Marriage Law it is expected to improve the status of women by protecting the rights of wives in the family. CHILD PROTECTION ACCORDING TO ISLAMIC LAW AND FORMAL LAW 根据伊斯兰法律和正式法律保护儿童

The word protection according to the Indonesian dictionary is a shelter or things (deeds and so on) that must be protected. Then, Law No. 23 of 2002 on child protection states that protection covers activities to guarantee and protect children and their rights in order to live, grow and participate optimally in accordance with human dignity, and to obtain protection from discrimination. If parents always protect and pay attention to their children as blessings of God and protect them from actions that can damage the future of the child, then parents should be responsible to keep and protect them. As stated in Tafsir al-Qurtubi which expressed the opinion of Ibn Abas in understanding the above verse: as a form of the command to the husband to protect himself and his family from the fire. The application of the verse in everyday life is to take care of one's self by observing the rules of religion and keeping the family by calling them to worship and pray to God, so they were saved from the fire. The most important issue that is always discussed by scholars of jurisprudence is the issue of parenting (Hadhonah) in order to maintain and sustain the continuity and preservation of the life of the newborn. Hadhonah is to nurture a child who has not been able to take care of his own life by providing something for the welfare and security, taking care of something painful and dangerous, educate and building himself physically and spiritually. Children are an Almighty's grace for parents, children are also mandated and jewelry for them, as well as pride in the future, but in addition, children can also be a slandered person or a test, even become enemies for their parents. The National Legal Development Board of the Department of Law and Human Rights provides an understanding that the harmonization of law as a scientific activity for the harmonization process (balance alignment) of written law that refers to philosophical, economic, and juridical values17 As from the description above, the harmonization of Islamic law into national law is a process of harmonization and alignment of Islamic law into national law as a form of making the legal product itself. From the description above, the author sees that the study of harmonization between Islamic law and national law is an interesting study because of the position of Islamic law as one of the National Law builders. In addition, this law is one form of the legal umbrella against childcare itself. So in the glasses of the author, this law is one form of implementing Islamic law into positive law. This is the first step in integrating positively of Islamic law into positive law. Therefore, the writing of this thesis entitled Child Protection according to Islamic Law and Formal Law with Law No. 23 of 2002 on Child Protection.Keywords: child, child protection, Islamic Law, Formal Law

THE ROLE OF NADZIR IN THE MANAGEMENT OF WAQF LAND IN RELIGIOUS AFFAIRS OFFICE (KUA) KADEMANGAN PROBOLINGGO nadzir在宗教事务办公室(kua) waqf土地管理中的作用探析

This research aims to know the role of nadzir in managing the Waqf land in KUA Kademangan Probolinggo, analyze nadzir Waqf in the management and development of Waqf land in KUA Kademangan City Probolinggo, and analyze how to certify Waqf land in KUA Kademangan Probolinggo. This research is in the nature of field research, which examines the provisions of the applicable law and the facts that apply in social life.This research is empirical juridical research, which is an approach that aims to obtain knowledge about how the legal relationship with society and the factors that affect the implementation of law in society (Mukhalad, 2020). From the results of the study, it was concluded that nadzir in KUA Kademangan Probolinggo in carrying out his duties to manage Waqf land has not been implemented properly. Nadzir of Religious Affairs Office (KUA) of Kademangan District is responsible aboutWaqf, but not as the manager. Nadzir of Religious Affairs Office (KUA) of Kademangan District is only in charge of providing information and administration in recording Waqf land and its vows. KUA of Kademangan district actually has planning and organizing but it does not include Waqf specific management. This is due to the fact that it is not a special office for Waqf management, however it is merged with marriage administration.Keywords: Nadzir, Waqf, KUA Kademangan

RECONCILIATION AS AN EFFORT TO FORM A PEACEFUL (SAKINAH) FAMILY IN ISLAMIC LAW REVIEW 在伊斯兰教法评论中,和解是形成一个和平(sakinah)家庭的努力

In a marriage life, of course, there are some problems that trigger disputes, such as economic problems, emotions, heredity or education. These problems become the cause of divorce between husband and wife. At the time of divorce, the wife is still in the period of iddah and that time can be used by her husband to refer back to himself. Therefore, this paper aims to know the opinion of imam madhhab about reconciliation, to know the problems that cause divorce, and to know the wisdom of reconciliation and the peaceful (sakinah) family.The method used in this study uses literature research or research called Library research, namely research of various reading materials, such as scientific journals, books, dan written works others related to the problems studied namely about refer as an effort to form a peaceful (sakinah) family in Islamic law review.The discussion of the scholars differs on the validity of a husband who wants to reconcile to his wife who is being accused of minor divorce (Talaq Raj'i) with deeds. Some allow (validate) the reconciliation, some validate but the intention should be clear and some do not validate at all reconciliation with deeds, but ones should recite it sarih (clear) and kinayah (satire). Regardless and differences of opinion, it would be nice if the implementation of refer enabled to give the opportunity to the husband and wife to repair the relationship that has been cracked, so that they can be whole again into a family that is sakinah, mawadah, warahmah as a goal and marriage without the intention to hurt their partner again.Keywords: reconciliation, sakinah family, and Islamic law

Therefore, this paper aims to know the opinion of imam madhhab about reconciliation, to know the problems that cause divorce, and to know the wisdom of reconciliation and the peaceful (sakinah) family.The method used in this study uses literature research or research called Library research, namely research of various reading materials, such as scientific journals, books, dan written works others related to the problems studied namely about refer as an effort to form a peaceful (sakinah) family in Islamic law review.The discussion of the scholars differs on the validity of a husband who wants to reconcile to his wife who is being accused of minor divorce (Talaq Raj'i) with deeds. Some allow (validate) the reconciliation, some validate but the intention should be clear and some do not validate at all reconciliation with deeds, but ones should recite it sarih (clear) and kinayah (satire). The purpose of this research is to deeply examine and analyze the implementation of the government system during the reformation era based on the 1945 Constitution. As stated in fourth paragraph of the Preamble of the 1945 Constitution, the National Independence of Indonesia is composed in a Constitution of the State of Indonesia which is structured in a form of Republic of Indonesia, governed with people sovereignty. The sovereignty of the people is the highest power and it determines the leaders in the Indonesian government. This is confirmed in Article 1 paragraph (2) of the 1945 Constitution. The subject regarding the government is stated in Article 1 paragraph (1) of the 1945 Constitution; Indonesia is a unitary state in the form of a republic. Based on these facts, it can be concluded that the form of the Indonesian state is unitary, while the form of government is a republic. The President of the Republic of Indonesia holds the power as the head of state and the head of government, as stated in Article 4 paragraph (1) that "The President of the Republic of Indonesia holds the power of government according to the Constitution." Perbedaan hukum batasan minimal usia pernikahan diindonesia kini menimbulkan permasalahan, sehingga undang-undang tersebut kembali diuji melalui sidang mahkamah konstitusi, undang-undang yang diuji yakni undang-undang tentang pernikahan no.1 tahun 1974 dan undang-undang nomer 16 tahun 2019 yang mana undang-undang ini masih memberikan peluang keapada masyarakat Indonesia untuk melakukan pernikahan anak di bawah umur. Undang-Undang Nomor 16 Tahun 2019 ini harus memandang dari berbagai aspek hukum yang lain dan mempunyai akibat hukum yang jelas, maka diperlukan revisi terhadap undang-undang ini secara menyeluruh. Bahkan kalau dapat, Undang-Undang Nomor 1 Tahun 1974 harus ditijau kembali dan disesuaikan dengan problematika hukum yang ada sekarang dan kedepannya. This study analyzes the active role of P2TP2A Probolinggo City in searching of ‎problem solving of various domestic violence that occur in Probolinggo City. As ‎one of the government institutions formed through the mandate of the law, ‎P2TP2A strives to carry out its main task, namely receiving reports of domestic ‎violence cases and finding the best solution in solving them. The finding of the ‎analysis is that the existence of P2TP2A is very much felt by the community. ‎Every year there are always problems that are reported and resolved through ‎mediation so as to maintain household harmony. In some cases, it continues to go ‎to court because the victim is adamant to use legal throught judge.‎

AKAD NIKAH VIRTUAL DALAM TINJAUAN HUKUM ISLAM

Tujuan penelitian ini ialah: 1) Menganalisa kedudukan bersatunya majlis ijab qabul didalam prosesi akad nikah menggunakan media virtual, 2) Menganalisa pandangan hukum Islam di Indonesia mengenai prosesi akad nikah menggunakan media virtual, 3) Menganalisa kesulitan yang muncul dalam pelaksanaan akad nikah menggunakan media virtual.Penelitian ini menggunakan metode library research, maksudnya ialah penelitian yang sumber datanya berasal dari kitab, buku-buku, karya tulis dan lain sebagainya yang ada kaitannya dengan permasalahan akad nikah menggunakan media virtual dalam perspektif hukum Islam.Dari hasil penelitian diperoleh kesimpulan bahwa akad nikah menggunakan media virtual secara syar’i dianggap sah, apabila rukun beserta syarat ijab qabul terpenuhi. Yang menjadi perbedaan bahwasannya mengenai pengertian satu majlis, ada pendapat yang mengatakan satu majlis disini hadir secara fisik dan ada pendapat lain dalam satu majlis disini ialah adanya kesinambungan antara pengucapan ijab dan qabul. Dalam prakteknya, pernikahan menggunakan media virtual kalau menganut pengertian satu majlis adalah kesinambungan antara ijab dan qabul tanpa memandang tempat dalam hal ini pernikahan menggunakan media virtual  tidak ada masalah, namun apabila menganut pengertian satu majlis menyangkut kedua belah pihak harus hadir dalam satu tempat, dalam hal ini pernikahan menggunakan media virtual dianggap tidak sah.Sesuai kesimpulan tersebut, diharapkan karya tulis ini bisa memberikan wawasan baru kepada masyarakat luas mengenai akad nikah menggunakan media virtual agar tidak hanya ikut-ikutan beranggapan bahwa pernikahan tersebut tidak sah tanpa mempelajari lebih dalam pokok permasalahnya. Sehingga, jika ada permasalahan baru yang berkaitan dengan hukum pernikahan di era modern ini, kita bisa bersikap lebih bijak dalam mengatasinya. Dan hendaknya sebisa mungkin bagi calon pasangan pengantin pelaksanaan akad nikahnya dilakukan secara wajar sesuai dengan yang ada di lingkungan sekitar tempat tinggal.
这项研究的目的是:1)用虚拟媒体分析婚姻状况中majlis ijab qabul的团结立场,2)用虚拟媒体分析印尼伊斯兰教对阿卡德婚姻法的看法,3)使用虚拟媒体分析阿卡德婚姻法中出现的困难。该研究采用图书馆研究方法进行,其数据来源来自伊斯兰法律中使用虚拟媒体的书籍、书籍、论文和其他有关的书籍。研究发现,阿卡德婚姻使用虚拟媒体是合法的,只要与伊贾布的条件达成一致。不同的是,关于一个majlis的理解,有一种观点认为一个majlis在物理上存在,另一种观点认为ijab和qabul之间存在延续。婚礼在实践中,使用虚拟媒体如果信奉理解一个化妆是ijab之间的连续性,qabul不论婚姻这地方使用虚拟媒体没有问题,然而当信奉理解majlis涉及双方必须参加一个婚礼,在这种情况下,使用虚拟媒体地方被认为是不合法的。根据这一结论,我们希望这篇论文能够为广大民众提供一个新的见解,让他们使用虚拟媒体,而不仅仅是假设婚姻是非法的,而不深入研究更重要的主题。因此,如果在现代社会有新的婚姻法问题,我们可以更明智地解决它们。而且应该尽一切可能让未来的新郎和新娘的婚礼按照自然环境进行。
