International Regulations of Greenhouse Gas Emissions from International Shipping 国际航运温室气体排放国际规则

This article assesses the current situation of ghg emissions from international shipping, recognizing the dire need of counter-responses from the industry. It examines the attempted international endeavor by the International Maritime Organization (imo) to regulate ghg emissions from international maritime transportation and seeks ways ahead in response to existing challenges. It is suggested that certain responses can be taken to overcome the insufficient action to ghg emissions from international shipping, including reinforcement of present technical and operational measures, adoption of market-based measures, capacity-building in developing countries, and regional and domestic measures of port States.

Cooperation by Pacific Island countries in the management of tuna fisheries is an important means of achieving sustainable development of these shared resources, in line with Sustainable Development Goal 14. The Western and Central Pacific Ocean (WCPO) tuna fishery is the largest tuna fishery in the world and two examples of arrangements based on regional cooperation are provided:•The purse seine Vessel Day Scheme (VDS) is a fisheries management system that is being implemented through the cooperation of the Parties to the Nauru Agreement (PNA), which regulates harvesting of tuna in line with SDG 14.4. The scheme also establishes rights in the shared fishery for small island developing states, increasing economic returns in support of SDG 14.7.•Regional cooperation in fisheries Monitoring Control and Surveillance is a unique collaboration between the members of the Forum Fisheries Agency (FFA) to address illegal, unreported and unregistered (IUU) fishing in support of SDG 14.4. A range of regionally agreed systems and tools is applied.

Maritime boundary disputes pose the most dangerous potential for conflict between States. Article 298 of UNCLOS was designed as a safety valve to allow exclusion of sensitive disputes arising out of contested maritime boundaries—but also to provide a safety net for peaceful resolution of all UNCLOS disputes. This paper offers views on four questions which remain unresolved. First, may States exclude obligations of restraint and cooperation under Articles 74(3) and 83(3) of UNCLOS from compulsory dispute settlement by an Article 298 declaration? Second, for submission to compulsory conciliation, what criteria should be used to decide if the dispute arose subsequent to the entry into force of UNCLOS? Third, does a court, arbitral tribunal or conciliation commission have jurisdiction to consider ‘mixed disputes’ involving land sovereignty or other rights? Fourth, what is the meaning of “shall, by mutual consent”—when conciliation fails to reach an agreement, are the parties bound to refer their dispute back to compulsory third party dispute settlement under section 2 of Part XV of UNCLOS?
