: One of the ways in which democracies check and channel institutional power is by establishing highly detailed procedures through which these institutions can act. That is what can be read, for example, in article 7 of the Chilean constitutional text, when it states that organs of the state act validly only when they have been legally invested in their powers and —most importantly for the purposes of this work— within the confines of their competences and in the form established in the laws. Has the Constitutional Court honored such basic principle of constitutionalism? This work argues that during the last two years the Court has entertained in a series of practices that have taken it to deceit the adjective rules governing its powers. This has occurred when it has unbound itself from the rules governing its powers. Infringing such rules as those governing competences and procedures is worrisome in its own merit, but particularly when we are assessing the exercise of power by an institution whose democratic credentials are, when compared with those of the other branches, weaker.

Resumen: Los crecientes fenómenos globales, las consecuencias derivadas del calentamiento global y otros eventos naturales, como las pandemias, generan tal impacto en nuestras sociedades que nos obliga a replantear profundamente nuestro sistema jurídico, particularmente ante el proceso constituyente que se desarrollará en Chile. Este trabajo pretende evidenciar el déficit normativo de los estados de excepción aplicados a situaciones de desastre, ya que estos mecanismos no fueron originalmente pensados para situaciones semejantes. Así, nuestra hipótesis sostiene que las deficiencias normativas respecto a los desastres socio-naturales son consecuencia de concepciones desactualizadas del “orden público”, “calamidad pública” y “seguridad nacional” a nivel constitucional. Esto hace necesario reorientar dichos conceptos, con el objetivo de optimizar los mecanismos de coordinación para dar respuesta a las emergencias y mejorar la gestión del riesgo de desastres. Para validar la hipótesis, el trabajo realiza un estudio de bibliografía especializada además de analizar decretos de declaración de estados de excepción Abstract: Increasingly, worldwide phenomena such as global warming and other environmental issues as the current pandemic, demands to reassess our own legal systems before the ongoing constitutional debate in Chile. This article intends to show the legal gap among the state of exception applied under these extreme circumstances, since such constitutional mechanisms were not designed to address them. Our hypothesis suggests that this legal gap is tied to out-of-date conceptions regarding “public order”, “public calamity” and “national security” as constitutional concepts. Thus, it is necessary to redirect those concepts, to take advantage of coordination devices to confront emergencies and improve risk management. To prove our hypothesis, this article analyses specialized bibliography over the topic, the legal decrees by which constitutional state of exceptions are formally declared in Chile since 2010, and the corresponding legislation.
