Though the concept of intra-party regulations (党内法规) has a long history in China, it was not until 18th October 2017 that a National Party Congress report adopted it for the first time. In the report to the 19th Party Congress, Xi Jinping made two direct references to ‘intra-party regulations.’ One was when summarising the achievements of 5 years of work since the 18th Party Congress: ‘the reform of the Party building system has been further advanced, and the intra-party regulatory system has been continuously improved.’ The other was when expressing expectations for future work. On the latter, Xi stated a need to ‘strengthen ability to govern according to the law, speed up the formation of an intra-party regulatory system that covers all aspects of Party leadership and Party building, and strengthen and improve the leadership of the Party over state organs of power.’ This background partly explains why the Central Committee of the Chinese Communist Party (CCP) issued a flurry of intra-party regulations around 2019. Amongst them, in September 2019, it issued the revised Chinese Communist Party Intra-Party Regulation Formulation Regulations (2019 Revision) (《中国共产党党内法规制定条例》), the Chinese Communist Party Intra-Party Regulation and Normative Document Filing and Review Provisions (2019 Revision) ( 《中国共产党党内法规和规范性文件备案审查规定》), and the newly formulated Chinese Communist Party Provisions on the Responsibility System for Intra-Party Regulation Implementation (for Trial Implementation) ( 《中国共产 党党内法规执行责任制规定 (试行)》). These three documents, together with the FiveYear Plan Outline for Central Intra-Party Regulation Formulation Work (2013–2017) ( 《中 央党内法规制定工作五年规划纲要(2013–2017)》) issued in 2013, all appear in translated form in this issue of Chinese Law and Government. In this article, I offer some background and explanation on the four documents.

Abstract ‘Intra-party regulations’ originated in the Chinese Communist Party’s (CCP) revolutionary period and developed in the reform period. As the process of ‘comprehensively deepening reform’ develops, the CCP seeks to promote its notion of ‘reform’ and the ‘rule of law,’ advancing ‘comprehensive strict governance of the Party’ (全面从严治党) and ‘comprehensive law-based governance of the country’ (全面依法治国) as an integrated whole, and pursuing an ‘organic unity’ of ‘governing the country according to law and governing the Party according to regulations.’ As a natural consequence, this approach creates new institutional demands and social foundations for the development of intra-party regulations. This article analyses the origin of intra-party regulations, examines the intersection between intra-party regulations and the project of building a ‘rule of law China,’ and probes intra-party regulation development trends. It demonstrates how the CCP seeks to use intra-party regulations to realise an ‘organic unity of governing the country according to law and governing the Party according to regulations.’

Abstract In recent years, the intra-party regulations of the Chinese Communist Party have been rapidly expanding their reach towards state laws. The driving factor is the country’s distinct party system. Different from the ‘power-limiting model’ to which political parties belong in the constitutions of the United States and countries of Europe, China’s political party system belongs to an ‘empowerment model’—a model that has been strengthened over the past decade. Under the ideology of ‘the Party leads everything’, intra-party regulations are no longer limited to regulating Party organisations and Party members but instead extend to a wide range of matters of public administration. The boundary between intra-party regulations and state laws is becoming increasingly blurred, and a tension is forming with the values of popular sovereignty, checks and balances on power, and rights protection contained in the Constitution of the People’s Republic of China.

Abstract For over a decade, the Chinese Communist Party has been building its rules into a coherent ‘intra-party regulatory system’ with implications for the way the Party runs itself and ‘leads’ its state. This article examines the system-building project through the lens of the Party’s relationship with its state. It draws on a comparative analysis of the different iterations of the Party Charter since the Party became ‘governing party,’ and of pre- and post-19th Party Congress versions of the foundational documents of the intra-party regulatory system. It argues that since the 19th Congress Party Charter transformed the Party’s longstanding articulation of its own identity, redefining ‘Party leadership,’ the intra-party regulatory system has begun to reflect this change. ‘Party leadership’ is by nature relational—it cannot be defined or practiced in a vacuum—hence the Party’s transformed notion of ‘Party leadership’ entails a reconfigured Party–state relationship. Examined in this context, the Party’s project of ‘intra-party regulatory system’ building appears to be reconfiguring the relationship between Party documents and state laws and policies.

This first issue of the relaunched Chinese Law and Government is being published as the Chinese Communist Party (CCP) holds its 20th National Party Congress. Party congresses have long drawn attention from scholars of Chinese politics. But personnel changes tend to capture the limelight, overshadowing amendments to the Party Charter and the policysetting role of the Report to the Congress (Miller, 2017; Tobin, 2020). This issue of Chinese Law and Government shows that important structural developments over the past decade demand renewed attention to the Charter and the Congress Report.
