The exercise of care is a right that is deployed in specific ways in different areas. The purpose of this article is to analyze the sex-affective ties in women deprived of their freedom, as a type of exercise of care. The sex-affective logics are presented in the situation of women incarcerated in the Buenos Aires Penitentiary Service (SPB), contemplating the contributions of the emotional turn. From the definition of the politicity of emotions, as a care activity, the links between women prisoners are analyzed, and the emotions they show in relation to their families, actors involved in the situation of deprivation of liberty and between their own women arrested. The article analyzes the emotions of women deprived of liberty and the specificity of them based on the modes of collective organization among women, taking the notion of affidamento networks. The article aims to make the definition of care more complex based on the contribution of the emotional turn and contributes to the study of the specificity of women in the plots of punitive power

This article describes the prevention as a mean of protection of personal rights which are compromised during the solidarity gestation from an approach that is in line with the constitutional and conventional vision in which is involved the Argentinian Civil and Commercial Code. In this framework and considering the principles and values of Families Law, following for that a path that describer the right to the prevention and reparation of the damage in a constitutional and conventional perspective. The description that is informed, allows to arrive to the study of the procreational will as an element that contributes to the elaboration of measures directed to avoid the production of a damage to the person. The Right of Families, as it is more accurately termed in a contemporary way, is based on the principles of equality, autonomy and solidarity, granting vulnerable people a primordial place in the Civil and Commercial Code of the Nation (CC and C). This acquires concrete legal effects in the intersection between protection of housing and the rights of children and adolescents (NNA), from a renewed regime of both the family home, and the exercise of rights by persons under 18 years of age, the light of the principle of progressive autonomy. Thus, we propose in this article to review critically, the aforementioned crossing through the norms that make up the current Family Law, as well as the jurisprudential panorama, from the validity of the CCyC. For this purpose, it is proposed to analyze 4 axes that reflect current issues in the matter: I) the exercise of rights of children in relation to the family dwelling by the attribution of their use in the face of crisis among the parents, II) the right to protection of children's housing in extra-family relationships, mainly cases of evictions, III) adolescents, progressive autonomy and access to housing based on the special assumption provided by Law 27,364 of assisted discharge for adolescents without parental care, and IV) the obligatory gender perspective in light of the role that women occupy in the protection of the housing of their sons and daughters.

En este articulo se describen y analizan las respuestas judiciales a los pedidos para acceder a las intervenciones quirurgicas genitales por parte de personas trans en Argentina entre 1994 y 2008. A traves del analisis de contenido cualitativo de una seleccion de fallos se analizan los cambios en los argumentos y los discursos invocados por los/as operadores/as judiciales intervinientes. Sostengo que en un primer momento la corroboracion pericial del sufrimiento psiquico asociado a un trastorno de la identidad de genero permitio la produccion de una serie de fallos favorables a las solicitudes de las personas para acceder a cirugias genitales y otras intervenciones medicas orientadas a construir una imagen corporal acorde a su identidad de genero. En un segundo momento, la apelacion a los principios de la bioetica principialista permitio afirmar la autonomia de las personas que solicitaban autorizacion, y el acceso a las intervenciones medicas como una eleccion libre y no ya como el tratamiento indicado para una patologia. Sin embargo, afirmo que se trato de un concepto de autonomia opaco y menguado, ya que operadores/as judiciales debian evaluar el caracter plenamente autonomo de los deseos corporales de las personas trans para autorizar el acceso a los tratamientos medicos requeridos. EnglishThis article presents an analysis of five judicial responses to requests for access to genital surgical interventions by transgender people in Argentina. It analyses the period from 1994 to 2008, prior to the approval of the Argentinean Gender Identity Law. In that period it was mandatory to have a judicial authorization in order to modify the name and sex in official identity documents and to access to medical treatments in order to adapt the body to gender identity. Through the analysis of qualitative content of a selection of judicial decisions, changes in arguments and discourses produced by the judicial field are analyzed. The article seeks to contribute to theoretical and empirical studies that address the ways in which the judicial field manages bodily desires of the transgender people and transforms their discourses. I argue that the expert corroboration of the psychological suffering associated with a gender identity disorder allowed the production of a number of judicial decisions favorable to the requests of trans people in order to access genital surgeries and other medical interventions. Later, bioethics principles allowed affirming the autonomy of trans people who requested the access to medical interventions as a free choice and no longer as the indicated treatment for pathology. En Argentina la centralidad de la prision preventiva y su utilizacion extendida son rasgos fundamentales del funcionamiento de la justicia penal. En los ultimos treinta anos se han producido una serie de procesos de reforma de la justicia penal, a nivel latinoamericano, que han tratado de cambiar la dinamica de su funcionamiento. En la provincia de Santa Fe, particularmente, estos cambios se han materializado en la sancion de un nuevo Codigo Procesal Penal en el ano 2007. En este articulo mencionaremos una serie de interpretaciones posibles sobre las modificaciones en el uso de la prision preventiva en el marco del nuevo proceso penal, partiendo del analisis de una serie de datos estadisticos sobre la poblacion privada de su libertad en establecimientos penitenciarios y policiales en el territorio de la provincia y del analisis de entrevistas semiestructuradas realizadas a los agentes de de la nueva justicia penal del centro y norte de la Provincia de Santa Fe.

espanolEn el Peru, la corporativizacion llego en el 2011a las Fiscalias Especializadas en Delitos de Corrupcion de Funcionarios (en adelante, FC Corporativas Corporativas), luego de un supuesto exito en la jurisdiccion civil. Priorizando la eficiencia por encima de la calidad, esta medida gerencialista planteo compartir tareas administrativas y juridicas entre los distintos fiscales, bajo el liderazgo de un fiscal coordinador. En los hechos, la corporativizacion estuvo lejos de alcanzar la eficiencia. En este articulo, analizamos como la generalidad de las reglas establecidas para el funcionamiento de las FC Corporativas y los rasgos de una cultura fiscal que desvaloriza lo corporativo en forma insidiosa, crearon incentivos que generaron la aparicion de cuatro estilos de gestion directamente influenciados por dos caracteristicas delos fiscales coordinadores (comunicacion y proactividad). Asumiendo que la cultura fiscal crea nuevos incentivos, especialmente en escenarios de transicion (hacia la corporativizacion y hacia la adopcion de un nuevo Codigo Procesal Penal), no exaltamos la cultura ni damos unica cabida a una mejor regulacion como eje de solucion. Sostenemos que la comprension de la interaccion entre regulaciones y cultura fiscal brinda un mejor espacio de trabajo para politicas publicas que busquen la eficiencia pero tambien la calidad del trabajo de los fiscales. EnglishIn 2011, Peruvian General Prosecutors in charge of corruption cases were clustered, after successful previous experiences in the civil jurisdiction. Clustering works by making efficiency –not quality– a priority and sharing administrative and investigation tasks among prosecutors led by a coordinator. In practice, clustering rarely achieved efficiency. In this article, we analyze how vague clustering regulations and an organizational culture that disregarded clustering created incentives that fostered four management styles influenced by two coordinators’ characteristics (communication and proactivity). Knowing that organizational culture creates incentives, especially in times of transition (like the clustering and the adoption of a new Code of Criminal Procedures), we don’t overestimate culture nor better regulations as solutions. It is the interaction between them what offers a better space for public policies seeking efficiency but also quality in General Prosecutors’ Office work.

Priorizando la eficiencia por encima de la calidad, esta medida gerencialista planteo compartir tareas administrativas y juridicas entre los distintos fiscales, bajo el liderazgo de un fiscal coordinador. En los hechos, la corporativizacion estuvo lejos de alcanzar la eficiencia. En este articulo, analizamos como la generalidad de las reglas establecidas para el funcionamiento de las FC Corporativas y los rasgos de una cultura fiscal que desvaloriza lo corporativo en forma insidiosa, crearon incentivos que generaron la aparicion de cuatro estilos de gestion directamente influenciados por dos caracteristicas delos fiscales coordinadores (comunicacion y proactividad). Asumiendo que la cultura fiscal crea nuevos incentivos, especialmente en escenarios de transicion (hacia la corporativizacion y hacia la adopcion de un nuevo Codigo Procesal Penal), no exaltamos la cultura ni damos unica cabida a una mejor regulacion como eje de solucion. Sostenemos que la comprension de la interaccion entre regulaciones y cultura fiscal brinda un mejor espacio de trabajo para politicas publicas que busquen la eficiencia pero tambien la calidad del trabajo de los fiscales. EnglishIn 2011, Peruvian General Prosecutors in charge of corruption cases were clustered, after successful previous experiences in the civil jurisdiction. Clustering works by making efficiency –not quality– a priority and sharing administrative and investigation tasks among prosecutors led by a coordinator. In practice, clustering rarely achieved efficiency. In this article, we analyze how vague clustering regulations and an organizational culture that disregarded clustering created incentives that fostered four management styles influenced by two coordinators’ characteristics (communication and proactivity). Knowing that organizational culture creates incentives, especially in times of transition (like the clustering and the adoption of a new Code of Criminal Procedures), we don’t overestimate culture nor better regulations as solutions. espanolLos cambios acaecidos en el sistema internacional y el posicionamiento de las unidades subestatales como actores del mismo trae a escena el replanteamiento del rol del Estado en las relaciones internacionales. El presente trabajo investigativo se ocupara de analizar como se configura la gestion internacional de las unidades subestatales de acuerdo al marco juridico estatal. A los efectos de esta investigacion se analizaran los casos de Argentina, Bolivia y Chile, haciendo especial referencia a las unidades subestatales de Jujuy, Tarija y Tarapaca respectivamente. En tal sentido las preguntas que guian la investigacion son: ?En que marco se configura la gestion internacional de las unidades subestatales??Reconoce el Estado la gestion internacional de las unidades que lo conforman? ?De que manera lo hace? ?Que tipo de relacion se plantea entre el Estado y las unidades subestatales? La capacidad de las unidades subestatalespara actuar de manera directa en el plano internacional ha sido reiteradamente reconocida, pero su fundamento juridico se encuentra disperso a lo largo de las normas legales de cada Estado y debe ser inferido del contexto, lo que implica que no existe un cuerpo legal generico que determine de forma explicita en que forma pueden o no actuar internacionalmente las unidades subestatales.De esta manera, la insercion internacional de las unidades subestatales se vera afectada por el grado de autonomia que le otorgue el marco constitucional del Estado que conforman y por el marco de la politica exterior. EnglishThe befallen changes within the International System and the placement of sub-state units as performers in the same reassessment stage of the State’s role in International Affairs. The current research work will analyze how the international management of sub-state units is set according to the State’s legal framework. The cases of Argentina, Bolivia and Chile will be analyzed with special reference to the sub-units of Jujuy, Tarija and Tarapaca, accordingly. The inquiries that serve as a guideline are: In which framework is the international management of sub-state units set? Is the international management of those component units recognized by the State? How is it acknowledged? What kind of relation is raised between the State and sub-state units? The sub-state units ability to act directly with the international level has been acknowledged repeatedly, but its legal grounds are scattered among the framework legislation of each State and has to be inferred by context, which implies that there’s no legal text that determines explicitly how are the sub-state units to act or not internationally. Thus, the international insertion of sub-state units will be affected by the autonomy level given by the legal framework from each State and that of foreign policy.
