The purpose of this paper is to analyze the elements and critically assess the regulation of the crime established in article 443 of the Organic Code of Courts. Using fundamentally a dogmatic methodology, the text mentions the historical background of the crime and examines the legislative technique used to describe it. Likewise, it analyzes the objective and subjective aspects of the legal description of the crime, highlighting various problems generated by its current regulation, especially from a systematic and evaluative point of view.
