Incest is a well-known phenomenon, defined as a sexual relationship between close blood relatives, usually between father-daughter, uncle-nephew and also brother-sister, or, in its broader sense, between a child and a stepparent or stepsibling. Incest is a taboo in many countries; however incest and sexual aggression toward minors are not classified as a criminal behaviour in all part of the world. our study has the purpose to examine the legislator’s attitude towards this social phenomenon in expansion. clinical Forensic approach to this phenomenon in literature is an essential contributory to explain the physical and psychological consequences; but it is yet certainly possible to ameliorate legal-medical procedures of investigation. We report the laws in force in different countries so to appraise the exact connotation of this crime in our country. the aim of this research is to take widest consciousness of the diffusion of this phenomenon in the health professionals and the difference of cultural approach in legal perspectives.

Battered Woman Syndrome
Pub Date : 1993-01-01 DOI: 10.4135/9781483365817.n160
P. Giannelli
:- Battered Woman Syndrome is an example of mental and social indications found in women who have been living in an oppressive relationship for an extremely lengthy time span. It is a sub-classification of PostTraumatic Stress Disorder (PTSD) and is showed as melancholy, uneasiness issues, low confidence, and regularly put women in danger of self-destruction or crime. Rather than ending this undesirable relationship with their victimizer, these women execute their victimizer to end the chain of abusive behaviour at home. Women come up short on the actual solidarity to battle their victimizers. So when the viciousness is at its pinnacle, these women slaughter their batterers in non-angry conditions however the courts actually convict them as killers. This article examines the disappointment of Indian Courts to recognize the way that mental attributes of women and men in cases like these are extraordinary and that women will not be needed to accommodate their mental qualities inside the ones relevant to men. The courts ought not to pass judgment on these women's activities dependent on the male experience. Besides, this article will likewise feature that as a women's activist model of statute Battered Woman Syndrome needs to look for legal acknowledgment in India and should be fused inside the Indian Criminal Framework as a safeguard for the vulnerable women. Ultimately, the article will close by proposing the approaches to incorporate BWS under the arrangements of Provocation, Private Defence, and Insanity.

Unlabelled: Consumption of alcohol and tranquilizers reaches a very high level in France. Studies about simultaneous alcohol and psychotropic drugs involvement in motor related fatalities have never been described in this country. A retrospective study was done on 482 fatalities broken down by drivers and pedestrians within one year (1987) in Région Nord-Pas de Calais (France).

Method: 132 cases met the criteria for complete study. Blood samples obtained at the time of death were analysed for alcohol (BAC) by gas-chromatography and assayed for barbiturates (BA), benzodiazepines (BE) and tricyclic antidepressants (TA) by Emit.

Results: Out of 132 fatalities there were 86% men (mean age 38.5 years) and 14% women (mean age 46 years). 57% belonged to the working population. Of the fatalities, 38% occurred from Friday 8 p.m. to Sunday 12 p.m. We distinguished 3 categories: pedestrians (18.2%), 2-wheel vehicles (19%) and 4-wheel vehicles (62.8%). Alcohol involvement is given in Table 2. [table: see text] Notice that 53% were above the legal limit (0.8 g/l) and 34.8% had no alcohol. Psychotropic drugs were detected in 10.6% of the cases (Table 3). [table: see text] BZ were found in 50% of men and 100% of women. drugs and alcohol were present simultaneously in 8.3% of the individuals. Results are in % of total in Table 4: [table: see text] Positive BAC and positive drugs are not related. No significant difference was found in the distribution of alcohol between positive or negative drugs findings. Our results are consistent with those described by North-American authors, but largely superior to those from French or other studies done only on injured persons.

Intoxilyzer 5000 Conclusive Breath Testing Devices have been in wide operational use in New Zealand since June 1989. From the monitoring of these devices, large number of duplicate subject test results and blood alcohol/breath alcohol pairs have been obtained. Information on the agreement between duplicate subject breath samples, the blood/breath correlation, and the distribution of breath alcohol levels encountered at each testing location will be presented. Each device has been closely monitored in the field with respect to its calibration status and stability; the devices have proved to be very satisfactory in the field.
