At the time of the Liberal Revolution (1820), the Portuguese Cortes had not met for more than a century and the idea of summoning them again gave rise to a heated dispute by the two forces in conflict – the Provisional Junta of the Supreme Government of the Kingdom (based in Porto) and the Regency of the Kingdom (based in Lisbon). On the revolutionary side, the Cortes were required to provide a Constitution to the country and to rescue it from the despotism of absolute monarchy. However, the Regency of the Kingdom decided to counterattack and to summon the traditional Cortes in order to halt the advance of the revolutionary movement. This article analyzes this failed attempt to resurrect the old Cortes, which has gone virtually unnoticed in the historiography of the Liberal Revolution and led to the adoption of the first Portuguese electoral law, so far unknown, which is analyzed here firsthand.

This text reproduces the report presented, for the purposes of final evaluation, at the I Post-Graduate Course in Equality Law, organized by the Private Law Research Center of the Faculty of Law of the University of Lisbon. The Portuguese Constitution defines and establishes the principle of equality as the basic principle of our legal system, and its application is reflected throughout the constitutional text, in the most diverse areas. The law of parity seeks – or intends – an implementation of this principle in political participation, and it must be questioned whether and to what extent such implementation takes place.

Although sidelined very often by, and when compared to the parliamentarian electoral law, the electoral law for the President of the Republic has past examples and a history, of which its knowledge should not be ignored by those who study the Political System of the Portuguese Democratic Regime. It is about understanding how we arrived at this way of electing the President of the Republic, to figure the steps taken to allow portuguese citizens living abroad to vote, and to identify the issues which deeply divided politicians and political parties. To know the previous cases and its forty-five-year long journey of the current electoral law for the President of the Republic is the goal of this study.
