Confronting the traditional system: a qualitative study on the challenges to school based restorative practices policy implementation 直面传统制度:基于学校的恢复性实践政策实施挑战的定性研究

ABSTRACT With the abundance of research that has come to fruition in recent years about the school to prison pipeline and rampant disproportionality of exclusionary discipline, the United States is starting to see a shift to a school-based restorative practices approach. Because of the nascent nature of this framework, research is far behind practice in schools, and knowledge about barriers to implementation is limited. This qualitative research study used purposive sampling and semi-structured interviews to review the experiences of 12 education professionals in San Diego County involved with restorative practice implementation. Participants believe an absence of administrative buy-in and a lack of resources prevent restorative practices from being executed with efficacy. Participants also stated that the resistance to change and the drastic change in culture, as well as societal factors, challenged restorative practices implementation. Findings suggest that restorative practices should be prioritized with intentionality by all levels of the public education system for more effective implementation in schools and more equitable outcomes for students.

ABSTRACT This essay is based on the assumption that retributive justice fails to capture the immense riches of the human condition. Exploring the South African Truth and Reconciliation Commission (TRC), it argues that restorative justice must be seen as complementary to the retributive and other conceptions of justice. Restorative justice is presented here as a spiritual journey, one that is best grasped through the prism of Benjamin’s spiritual elements of class struggles. Nelson Mandela understood, like Georg Friedrich Hegel, that even the Absolute Spirit, powerful as it is, achieves its goal through cunning. Spiritual quest is, however, much more than the cunning of the spirit; it is also love and human flourishing understood as inclusive projects.

Restorative justice: a qualitative analysis of school security perspectives 恢复性司法:学校安全视角的定性分析

ABSTRACT Grounded in Restorative Justice theory, the current study examines the perspectives of School Resource Officers (SROs) and other School Security Personnel (SSPs) during a professional development training on restorative-problem solving. Specifically, focusing on how school security staff are currently using restorative justice in their work, how they can use these practices in the future, and any variations in perspectives towards restorative justice based on their job title. A qualitative phenomenological methodology was used to analyze qualitative responses to training logs from SROs and SSPs (n = 99). Throughout the module, participants were asked to reflect on five different situations and provide examples of how they would address these issues using restorative justice. Codes and memos were used to summarize the themes across participants. Both SROs and SSPs are aware of restorative practices and use them to some capacity in their roles. However, additional training is needed to ensure that practices are used consistently and effectively across positions and schools. To abolish the U.S. school-to-prison pipeline, all school staff including security should receive mandatory, ongoing, evidence-based professional development for school-wide implementation of restorative justice as an alternative to punitive disciplinary strategies that disproportionately harm students of color and their families.

Restorative justice: a substantive, intergenerational and ecological approach in the Amazon Region of Brazil 恢复性司法:巴西亚马逊地区的实质性、代际和生态方法

ABSTRACT From the report of a case in which restorative justice references were used to address a conflict involving chestnuts gathers and family farmers in the Brazilian Amazon, the article reflects on the conditions of applying restorative justice concepts and procedures to treat socio-environmental conflicts. Restorative philosophy adopts a substantive vision concerned with an intergenerational and ecological ethic that can contribute to the realization of justice and the sustainability of peace in Amazonian scenarios. In order to face an alienating vision that disregarding human multidimensionality, the authors suggest a holistic understanding of reality that understands nature as part of what we are, that we inhabit, with which we are ineluctably interconnected and that is impacted by human actions, especially those of apolitical character and economical. This comprehending leads them to an ecological and intergenerational perspective of restorative justice that transcends the de-identification of humanity with nature. Understood in this way, restorative justice implies responsibility towards human beings and nature. This means looking for solutions that meet not only the needs of the actors directly and indirectly affected by a particular offense; in addition to intersubjective issues, it concerns the satisfaction of demands for social justice and environmental conservation, inviting humanity to render intergenerational accounts. The article concludes that an ecological and intergenerational view of restorative justice requires exercises of imagination and effective practice capable of facing the tangles of the humanity-nature relationship within extended perspectives that account for considering the multidimensionality of the human experience.

Contemporary Justice Review exists to provide an interdisciplinary, peer-reviewed journal for scholars, activists, and practitioners of social and restorative justice around the globe who seek to share their theoretical, research-based, and applied work on the design and implementation of models of justice that take into account the needs of all. The journal’s articles have undoubtedly contributed to global discourse on the usefulness of restorative justice in disrupting trajectories into the criminal legal system and prison industrial complex, confronting racial, class, and immigration injustice, combatting gender-based violence and discrimination in all its forms, and transforming practices, policies and ideologies for a just world. In alignment with our interdisciplinary and global aims, the articles in this issue represent diverse perspectives and approaches to social, restorative and transformative justice from around the world. The timely and thought-provoking empirical research by Bello and Matshaba (South Africa) on university student perceptions of policing and their obedience and willingness to cooperate supports arguments that favor the adoption of just procedures that treat people fairly and with dignity and respect in place of reactionary policing. Similarly, Gawley, Cuellar, and Coyle (United States) explore the relationship between authoritarianism in schools and student behavior and suggest that preventive evidence-based therapeutic interventions, when used as viable alternatives to reactionary procedures, can result in enhanced school safety and promote positive student development. Asadullah and Morrison (Canada) draw attention to the roots and evolution of the restorative justice movement to refocus our lens on practices and initiatives that are community born, based, and led. Jokinen (Finland) addresses the moral conflict that divides critical feminist theory and restorative justice advocacy in cases of domestic violence. Bolaji’s (Ghana) phenomenological account of deep-rooted socio-political conflict in Dagbon provides a context for exploring the principle factors that position restorative justice as a central part of securing forgiveness, reconciliation and development in the region. Salm, Da Silva Neto, and Pamplona take us on a journey deep within the Brazilian Amazon to witness the rebirthing of culture, ecology, and the collective, which together create the conditions that inspire the use of restorative philosophy to resolve conflict. While weaving praxis and theory with eloquent prose, these authors reach out holding hands deeply soiled with fertile visions of a sustainable planet and join the call for us to live restoratively. Bolaji’s (Ghana) phenomenological account of deep-rooted socio-political conflict in Dagbon provides a context for exploring the principle factors that position restorative justice as a central part of securing forgiveness, reconciliation and development in the region. Salm, Da Silva Neto, and Pamplona take us on a journey deep within the Brazilian Amazon to witness the rebirthing of culture, ecology, and the collective, which together create the conditions that inspire the use of restorative philosophy to resolve conflict. While weaving praxis and theory with eloquent prose, these authors reach out holding hands deeply soiled with fertile visions of a sustainable planet and join the call for us to live restoratively. ABSTRACT There has been ebbs and flows, since 1982, with the growth of Restorative Justice (RJ) practices in British Columbia (BC), Canada. To date there are more than seventy plus organizations that offers RJ practices in BC. Using in-depth key informant interviews, along with surveys, this research seeks to understand the genesis and praxis of RJ in BC. This study finds that the local community’s involvement was of paramount importance to the growth of restorative justice. Key findings include the contribution of Community Justice Initiative Langley, Community Accountability Programs and SFU’s Centre for Restorative Justice. A number of emergent themes are discussed in the paper that include the role of the written RJ script, and standardization. The findings are significant for a number of reasons, first of all, it reveals the role of community, government and university collaboration. Secondly, emergent themes discussed in this paper illustrate the tensions within RJ praxis in BC where learning and growth are creating new understanding and insight. A detailed analysis on standardization debate and scripted vs non-scripted model of RJ are also discussed. This paper concludes that future research needs to focus on the relationship between restorative justice and Indigenous justice in BC.

Exploring procedural justice, obligation to obey and cooperation with the police in a sample of university students 以大学生为样本探讨程序正义、服从义务与警察合作

ABSTRACT This study scrutinizes the applicability of the Tylerian process-based model of regulation to the South African context. In any democracy, the police do not operate in isolation, but rely on public obedience and cooperation for the actualisation of their constitutional responsibilities. Previous studies on obligation to obey and cooperate with the police have focused on the general population with less consideration for specific component of the population, namely, university students. But with the frequent police-students encounters, we are uncertain whether university students will be willing to obey and cooperate with the police or not. Using a sample of 683 participants from a large university in South Africa, we test the effect of both normative and instrumental factors on university students’ obligation to obey, and willingness to cooperate with the police. This current study corroborates previous findings that emphasized willingness to obey and cooperate with the police if the police are procedurally just and effective in discharging their constitutional duties.
