Mutual complicity, state irrelevance, and restorative justice: Dagbon’s future in dire need of reciprocal royal forgiveness

ABSTRACT This article is a phenomenological account of the grievances that the two royal gates openly express as the main issues that have cumulatively shaped the conflict and which may decide the future contours of the conflict. It relies on the findings from the qualitative interviews conducted with the key protagonists of each gate, their sympathizers, and the custodians of the kingdom. Having acknowledged the intractability of the conflict and its complications, it explains the study’s methodology and the colonial roots of the conflict. The article also analyses how the post-colonial state mismanaged the Dagbon crisis with its centralist intrusions. Moreover, it reviews the literature on restorative justice highlighting its conceptualisation, dimensions, relevance, status vis-à-vis the criminal justice system, and its challenges in conflict resolution. Also, it explores the core grievances of the two royal gates in the light of cultural interpretations and the apparent contradictions. Furthermore, while it investigates the prospects of a traditional dispute resolution mechanism in a bid to restore justice and set the kingdom on the path of sustainable peacebuilding, it questions the excitement that accompanied the 2019 instalment of a new Yaa-Naa and warns about the dangers of a politically motivated conflict settlement that may backfire.

ABSTRACT This article defines mindfulness and trauma, and explores the benefits of a mindfulness practice in classroom settings to empower students socially, emotionally, and physically. More specifically, this article explores the implementation and benefits of a mindfulness practice in academic settings, especially to address trauma, highlighting the benefits of Transformative Life Skills (or TLS) as a formal mindfulness practice to institute in educational institutions. Finally, this article addresses possible challenges with implementing mindfulness strategies in schools and the need for increased research illustrating the impact of mindfulness practices on student populations who have faced trauma.

Lost in translation: experiences of ESL/LEP civil protection order petitioners

ABSTRACT The current study seeks to better understand the experiences of English as Second Language (ELS) and/or Limited English Proficiency (LEP) petitioners as they access the court system for civil protection orders. In analyzing structured observations of protection order hearings, three themes emerged: 1) Delays in Court for ESL/LEP Cases, 2) Judicial Reactions to ESL/LEP Applications, and 3) ESL/LEP Petitioners’ Experiences are Lost in Translation. Together, these themes suggest that language barriers exacerbate vulnerability to re-victimization and contribute to a broader understanding of justice system linguistic integration. To better address the needs of ESL/LEP populations, civil court systems must not only employ additional qualified interpreters but also ensure that they have received the highest certification possible. Acquiring added fiscal resources is key. Directions for future research are also noted.

Solving moral conflicts. Case restorative justice in domestic violence cases
Q2 Social Sciences Pub Date : 2020-09-13 DOI: 10.1080/10282580.2020.1819803

ABSTRACT Although restorative conflict resolution is gaining a steady foothold in many contexts, the context of domestic violence is strongly debated. The debate has been continuing and it still does. The argument in this paper sustains that the debate represents a typical conflict. When appreciating one, it is important to discern the core of it. The paper goes then on to arguing that the debate represents a typical moral conflict, rather than a judicial or a political one. The paper aims at establishing a framework for solving of moral conflicts, in the light of the debate between the advocates and the critics of restorative justice in domestic violence cases. As such the paper seeks to make a contribution to not only the debate relating to restorative justice in domestic violence cases but to restorative conflict resolution in general and to conflicts typical in societies today.

Situating restorative justice in novel jurisdictions: considerations from the Malaysian experience

ABSTRACT Restorative justice has been seeing increasing global success, and its effectiveness has been supported by decades of research. However, the implementation of restorative justice in novel jurisdictions presents serious challenges, from details to fundamental questions about where restorative justice should be situated in the criminal justice system. Using the case study of Malaysia, this article highlights the early considerations for implementation, with special attention to the position of victims in the process. This article also looks at the relative benefits of implementing restorative justice inside and outside the criminal justice. Our aim is to provide a robust discussion of the unique practical considerations faced when implementing restorative justice in novel jurisdictions, including outside of the West.
