Tanggungjawab pada Notaris, dalam hal terjadinya pidana pemalsuan surat yang dilakukan oleh para pihak ataupun Notaris itu sendiri dalam membuat suatu akta, dimana muaranya apabila Notaris tidak menjalankan ketentuan yang suadah diatur di dalam undang-undang, maka akan menimbulkan terjadinya perbuatan pemalsuan atau memalsukan sebuah akta yang dibuat sebagaimana dimaksud dalam Pasal 263 KUHP, sehingga dapat menimbulkan kerugian bagi para pihak yang berkepentingan. Akibat hukum dari akta notaris yang dibuat berdasarkan surat palsu dan keterangan palsu sesuai dengan ketentuan Pasal yang tertera dalam Pasal 1320 dan Pasal 1335 KUHPerdata yaitu suatu akta yang dibuat berdasarkan sebab yang palsu atau di palsukan, akan batal demi hukum nitiegbaarheid, dapat dibatalkan dan kekuatan pembuktiannya menjadi akta di bawah tangan.Kata kunci: notaris, pemalsuan, akta, pembuktian Responsibility to the Notary, in the event of a criminal forgery of a letter made by the parties or the Notary itself in making a deed, in which case if the Notary does not carry out the provisions which are set forth in the law, it will lead to fraud or falsification of a deed made as referred to in Article 263 of the Criminal Code, so that it can cause harm to the parties concerned. Di dalam agama Islam wakaf merupakan ibadah yang bernuansa penuh dengan rasa cinta kasih terhadap sesama manusia, menyejahterakan kepentingan orang lain bahkan kepentingan umum, dengan mewakafkan harta benda maka, akan tercipta solidaritas seseorang terhadap sesamanya. Akan tetapi di lapangan sering terjadi sengketa yang didahului oleh unsur kepentingan. Dalam penyelesain sengketa menggunakan metode penyelesain sengketa di luar pengadilan atau non litigasi yaitu menggunakan metode mediasi yang di lakukan oleh nadzir dan waqif dalam penyelesaian masalah. Adapun faktor dari sengketa khusus Masjid Tawakkal adalah unsur kepentingan baik oleh wakif maupun nadzir sedangkan peranan Badan Wakaf Indonesia dalam penyelesaian sengketa wakaf adalah berpedoman pada pasal 62 ayat 1 dan 2 Undang-undang Nomer 41 tahun 2004 yaitu BWI dalam penyelesaian sengketa wakaf mengedepankan musyawarah mufakat.Kata kunci: penyelesain sengketa, wakaf, nadzir dan wakif In Islam, waqf is nuanced worship full of love for fellow human beings, welfare of the interests of others and even public interests, by endowing property, there will be a solidarity between one another. Hak Milik atas tanah sifatnya turun temurun, dan mempunyai sifat terkuat, namun bagaimana jika sertifikat yang kita miliki hilang, apakah hak kita juga akan hilang. Hal ini akan penulis bahas dalam bagaiman proses penerbitan sertipikat pengganti yang hilang oleh kantor Pertanahan Kabupaten Pasuruan dan Hambatan apa yang terjadi dalam pengurusan sertifikat pengganti tersebut. Hasil penelitian jika sertifikat yang kita miliki tersebut hilang dapat mengajukan permohonan penerbitan sertifikat pengganti oleh Kantor Pertanahan dengan prosedur dan syarat-syarat yang telah ditetapkan oleh peraturan perundang-undangan. Akan tetapi dalam penerbitan sertifikat pengganti banyak kendala yang di hadapi yaitu selain waktunya yang panjang juga keterbatasan suberdaya manusianya dari pihak kantor pertanahan Kabupaten Pasuruan dalam pendaftaran yang serba online yang baru diberlakukan di kantor pertanahan seluruh Indonesia. Jalan keluar adanya pemangkasan prosedur dalam penerbitannya sehingga tidak memerlukan waktu yang panjang dan tidak berbelit belit.Kata Kunci: penerbitan sertipikat pengganti, hilang Property rights over land are hereditary, and have the strongest nature, but what if the certificate we have is lost, will our rights be lost. This will be discussed by the writer in how the issuance process of the lost certificate by the Pasuruan Regency Land Office and the obstacles that occur in arranging the replacement certificate. The results of the study if the certificate that we have is lost can submit a request for the issuance of a replacement certificate by the Land Office with the procedures and terms set by the legislation. However, in the issuance of substitute certificates there are many obstacles faced, namely in addition to the long time also the limitations of human resources from the land office of Pasuruan Regency in the all-online registration that was only implemented in the land offices throughout Indonesia. Kedudukan hukum terhadap akta yang memuat klausula accesoir dalam rangka memberikan perlindungan hukum bagi profesi Notaris merupakan akta yang autentik. Penambahan kalusula accesoir tersebut tidaklah bertentangan dengan peraturan manapun, termasuk UUJN. Penambahan kalusula accesoir dapat dimasukkan kedalam akta selama dibatas wajar (tidak berlebihan) dan diketahui serta disetujui oleh para pihak yang menghadap, sehingga kedudukan akta tersebut tetaplah menjadi akta yang autentik yang menjadikannya produk hukum yang sempurna sebagai alat bukti.Kata kunci: akta notaris, perlindungan hukum, efektifitasThe legal position of the act containing the accesoir clause in order to provide legal protection for the notary profession is an authentic act. The addition of the accesoir case is not contrary to any rules, including the UUJN. The addition of accesoir can be incorporated into the deed as long as it is reasonable (not exaggerated) and acknowledged and approved by the parties facing it, so the position of the act remains an authentic act which makes it a legal product perfect as a means of proof. Penelitian ini memiliki tujuan untuk memaparkan bagaimana praktek dalam pembuatan covernote serta tanggung jawab dan akibat hukum dari pembuatan covernote yang dijadikan dasar dalam perjanjian pembiayaan di Bank Muamalat Cabang Denpasar. Adapun praktek dalam pembuatan covernote terletak di tahap realisasi pembiayaan yang ada di Bank Muamalat Cabang Denpasar, dan tanggung jawab notaris terletak pada tanggung jawab moral yang menyangkut nama baik notaris serta akibat hukum timbul jika terjadi wanprestasi oleh notaris yang menimbulkan kerugian bagi pihak banksehingga dapat dikenakan sanksi secara hukum perdata maupun adminitrasi.Kata Kunci : covernote, tanggung jawab, akibat hukum, bank syariah. The aim of this study is to portray the implementation of compiling covernote as well as the notary’s responsibility and legal consequences that are used as the basis foundation of financing agreement at Bank Muamalat Denpasar. The implementation of making covernote at Bank Muamalat Denpasar is on the stage of financing realization. The notary’s responsibility is the moral responsibility in regard to his reputation and the legal consequences that may emerge if there is a default performed by the notary in which it will harm the bank. Penelitian ini memiliki tujuan untuk memaparkan mengenai konsep ideal imunitas hukum bagi notaris ditinjau dari segi peraturan perundang-undangan di Indonesia dan perlindungan hukum terhadap notaris yang membuka kerahasiaan isi akta di pengadilan. Konsep ideal imunitas bagi notaris yang didapat dalam penelitian ini adalah dimana notaris dapat perlindungan hukum dari kemungkinan terkena sanksi karena menjalankan kewajiban sebagai saksi dan melindungi notaris dari akta yang bermasalah, dengan konteks pembuatan akta yang secara administrative adalah benar namun dalam proses pengkonstantiran kedalam bentuk akta, terjadi manipulasi data oleh klien tanpa sepengetahuan notaris.Kata Kunci: imunitas hukum, perlindungan hukum, kerahasiaan This research aim to explain about ideal concept of legal immunity to a notary reviewed from legislation aspects in Indonesia and legal protection toward notary which reveal the secrecy of deed contents in the court. Ideal concept of immunity to a notary that has been found in this research is where the notary receive legal protection from the probability of given sanctions because of perform the duty as a witness and protect the notary from problematic deed, with the context that deed making administratively is right yet in process of to the deed form, there were data manipulation done by the client without notary known.Keywords: legal immunity, legal protection, secrecy

Isi akta yang diingkari oleh para pihak setelah salinan akta diterima oleh para pihak belum ditemukan peraturan yang mengaturnya, padahal dalam Pasal 16 ayat (1) huruf d Undang-undang Nomor 2 Tahun 2014 mewajibkan notaris untuk mengeluarkan salinan dari akta yang telah dibuatnya. Jenis penelitian hukum yang digunakan dalam penulisan tesis ini adalah yuridis normatif. Hasil pada penelitian menunjukkan bahwa Akibat hukum bagi para pihak yang ingkar terhadap isi dari akta notaris yang telah dikeluarkan salinannya adalah para pihak dapat dikenakan pasal 264 dan 266 KUHP karena memberikan dan memasukkan keterangan palsu di dalam akta otentik dan kedudukan hukum salinan akta notaris yang isinya diingkari oleh para pihakadalah menjadi batal demi hukum karena akta tersebut cacat dalam isinya yaitu mengandung unsur penipuan. Pendaftaran Tanah Sistematis Lengkap (PTSL) merupakan salah satu program yang diselenggarakan oleh Pemerintah untuk membantu masyarakat dalam memperoleh sertipikat tanah yang sebelumnya bernama Proyek Operasi Nasional Agraria (1981) dan Program Nasional Agraria (2015). Kota Batu merupakan salah satu kota di Indonesia yang mengikuti PTSL untuk membantu masyarakat yang mayoritas di antara mereka belum mendaftarkan tanahnya ke kantor pertanahan Kota Batu. Tujuan penelitian ini yaitu mengetahui dan menganalisis perbandingan antara pelaksanaan Prona dan PTSL di Kota Batu. Metode analisis yang digunakan dalam penelitian ini yaitu penelitian yuridis-empiris dengan pendekatan yuridis-sosiologis. Prona di Kota Batu merupakan pendaftaran tanah sporadis, aturan terkait biaya yang ditarik dari masyarakat yang belum jelas, dan pengukuran hanya dilakukan terhadap obyek yang dimohonkan saja. Sedangkan PTSL bersifat sistematis, aturan yang jelas terkait penarikan biaya dari masyarakat, dan pengukuran dilakukan kepada seluruh bidang tanah dalam satu wilayah.Kata Kunci: Perbedaan, Persamaan, Pendaftaran Tanah Sistematis Lengkap, Program Nasional Agraria Systematic and Complete Land Registration (PTSL) is a program organized by the Government to assist the public in obtaining the certificate of the land that was formerly the National Agrarian Operation Project (1981) and National Programmes Agrarian (2015). Batu City is one of the cities in Indonesia that follow to help communities that PTSL majority among those yet to register their land to land the Batu City. The purpose of the research is to find out and analyze the comparison between the implementation of Prona and PTSL in Batu City. Methods of analysis used in this study i.e. the juridical research-empirical juridical approach-sociological. Prona in Batu City is the sporadic land register, related costs rules drawn from the communities that are not yet clear, and the measurements are only done to the object that appealed only. Permasalahan yang diteliti tentang pembatalan akta hibah oleh ahli waris dan tinjauan hukum Islam dalam pembatalan akta hibah oleh ahli waris setelah putusan Pengadialan Agama. Ahli waris dapat mengajukan suatu pembatalan hibah melalui permohonan pembatalan di Pengadilan Agama dan dengan adanya putusan pembatalan hibah yang telah memiliki kekuatan hukum tetap, maka berakibat hukum dengan segala macam barang yang telah dihibahkan dikembalikan kepada si penghibah atau ahli warisnya. Kompilasi hukum Islam memberikan batasan dalam pemberian hibah hanya 1/3 dari harta warisan dengan pertimbangan kemaslahatan bagi ahli waris. Menurut Kompilasi Hukum Islam bahwa hibah dalam perkara ini tidak sah dan dapat dilakukan penarikan atau pencabutan kembali. Karena tidak terpenuhinya salah satu persyaratan dalam syarat-syarat Pemberian hibah menurut hukum Islam.Kata kunci : hukum Islam, pembatalan akta, hibah, Notaris, ahli waris Problems examined regarding the cancellation of the grant by the heirs and Islamic law review in the cancellation of the grant by the heirs after the decision of the Religious Funding. Kedudukan akta buy back guarantee dalam sistem hukum jaminan tidak berbeda halnya dengan akta-akta notariil lainnya yang digunakan pada lembaga penjaminan. Ia berfungsi sebagai perjanjian ikutan/pelengkap (accesoir) dari perjanjian kredit, yang banyak digunakan pada perjanjian pemberian Kredit Pemilikan Rumah (KPR). Penggunaan akta buy back guarantee karena pada akhirnya bank menempuh upaya lelang, sehingga terkesan bahwa akta buy back guarantee hanyalah ikatan moral belaka, namun tetap diperlukan oleh perbankan sebagai alternatif lembaga penjaminanKata kunci: buy back guarantee, kekuatan hukum, kredit macet.The position of the buy back guarantee deed in the guarantee legal system is not different from the other notariil deeds used in the guarantee institution.
