The Empowerment of The Council of Advising and Preservation of Marriage (BP4) in Building Sakinah Families 授权婚姻咨询和维护委员会(BP4)建立Sakinah家庭

Every time a household is built, there is certainly a hope of achieving happiness, sakinah, mawaddah wa rahmah, which is the purpose of marriage. Divorce can be carried out as an emergency exit, and it is not an urgent thing that must be done, but the most hated of permissible things. Divorce cases in the Religious Courts of Lampung Province increase every year, which shows that the performance of BP4 Lampung has not been optimal. Therefore, it needs to be evaluated scientifically. The objective of this study is to find a form of reconstruction of the work management of BP4 Lampung in building a sakinah family. This study used qualitative research with a descriptive-analytical type. The approach used interviews, documentation, and observation. The work management of the BP4 Lampung in realizing the sakinah family includes: First, the selection of management and organizational members who have spiritual, cultural, and intellectual dimensions; Second, the provision of honorary and social security; Third, training and development or competency development and training. Reconstruction that can be carried out is budgeting, where after the issuance of the law on regional autonomy, then BP4 Lampung, which is a partner of the Ministry of Religion and related agencies in improving the quality of marriage by developing the sakinah family movement, should get attention in the whole budgeting problem by the government, so that this program can be run optimally. To policy makers, both from the legislative and executive elements, along with the scholars, they should be proactive in paying attention to and following up on very complex Muslim problems, especially in the realm of Islamic family law and at the same time damaging the morals and values of the society in general. In this case, the most important problem is the prevalence of divorce practices in Lampung which have a negative impact on the psychological development of families.Setiap terbangunnya rumah tangga, tentunya ada sebuah harapan tercapainya kebahagiaan, sakinah, mawaddah wa rahmah, begitulah tujuan dari perkawinan. Perceraian dapat dilakukan sebagai emergency exit, dan bukanlah hal urgen yang harus dilakukan, melainkan kebolehan yang dibenci. Kasus perceraian di lingkungan Pengadilan Agama Provinsi Lampung tiap tahun meningkat, hal ini menunjukkan bahwa kinerja BP4 Lampung belum berjalan optimal, sehingga perlu dievaluasi secara ilmiah. Penelitian ini bertujuan untuk menemukan bentuk rekonstruksi terhadap manajemen kerja BP4 Lampung dalam membangun keluarga sakinah. Penelitian ini merupakan penelitian kualitatif dengan jenis deskriptif-analitis. Pendekatan yang digunakan menggunakan wawancara, dokumentasi dan observasi. Preferences of Children's Religious Interfaith Marriages: Case Study in The International Conference on Religion and Peace (ICRP) 儿童宗教间婚姻的偏好:宗教与和平国际会议案例研究

This research focuses on normative juridical aspects related to the tendency of religious selection in children as a result of Interfaith Marriage (PBA). With the approach of the sociology of religion and the psychology of child development, this study looks at how the pattern of children’s education influences the tendency of the religion child's selection. Research informants are four PBA pairs taken randomly in the International Conference on Religion and Peace (ICRP) organization. The research findings explain that children's religious preferences follow the path and parenting patterns of their parents who have different religions. In this study there were at least three parenting practices applied by parents of interfaith marriages. First, parents of married couples of different religions teach two religious teachings at once. Secondly, one of the couples from interfaith marriages took over the child's religious education so that the children followed their religion. Third, an agreement to make one child join each parent's religion. The pattern of nurture and religious environment that is applied by interfaith married couples to their children, related to religion, is very influential in the development of children's religious understanding. Religious education that is tolerant and understands religious plurality is a basic basis so that children are not trapped in psychological conflicts blaming one of their parents’ religions. This research is expected to contribute to the development of family law, particularly law on protecting children.Penelitian ini memfokuskan pada aspek yuridis normatif terkait dengan kecenderungan pemilihan agama pada anak hasil Pernikahan Beda Agama (PBA). Dengan pendekatan sosiologi agama dan psikologi perkembangan anak, penelitian ini melihat bagaimana pola pendidikan anak yang berpengaruh terhadap kecenderungan pemilihan agama anak tersebut. Informan penelitian adalah  empat  pasangan PBA dalam lingkungan organisasi International Conference on Religion and Peace (ICRP) yang dipilih secara random. Temuan penelitian menjelaskan bahwa preferensi agama anak mengikuti alur dan pola pengasuhan kedua orang tua mereka yang berbeda agama. Hasil penelitian menunjukkan bahwa  ada tiga pola asuh yang diterapkan oleh orang tua pernikahan beda agama. Pertama, orang tua dari pasangan nikah beda agama mengajarkan dua ajaran agama sekaligus. Kedua, salah seorang pasangan dari pernikahan beda agama mengambil alih pendidikan agama anak agar anak-anak mengikuti agamanya. Ketiga,  kesepakatan untuk menjadikan salah satu anak ikut agama masing-masing orang tua. Pola pengasuhan dan lingkungan keagamaan  yang diterapkan oleh pasangan nikah beda agama kepada anak-anak mereka, terkait dengan agama, sangat berpengaruh terhadap perkembangan pemahaman agama anak-anak. Pendidikan agama yang toleran dan memahami pluralitas agama menjadi basis dasar agar anak-anak tidak terjebak dalam konflik psikologis menyalahkan salah satu agama orang tuany

The Concept of Istitā‘ah Al-Bā’ah in Marriage 婚姻中的伊斯兰教概念

Islam has to law of sharia a marriage between men and women in order to build a family that is sakinah, mawaddah and rahmah. In order to achieve the goal of marriage, Islam has set a requirement for married couples to have several abilities to marry which is termed as istitā'ah al-bā'ah. Practically, there are still many people in marriages understanding the concept of istitā’ah al-bā’ah partially and even not applied it at all. The objective of this study is to examine the concept of istitā’ah al-bā’ah as a requirement in marriage and to explain its types and criteria according to sharia perspective through library research on Fiqh Principle and content analysis of Fiqh books. This study deeply analyses the collective data. This study has successfully found the types and criteria of marriage recommended in marriage, firstly, non-material abilities including an ability to have sex, physical health from dangerous diseases, and age. The second is material ability including an ability to meet the cost of marriage consisting of paying dowry and living. This study contributes to the context of strengthening the ability standards for couples wishing to get married. Therefore, fulfilling the requirements of the abilities to marry is expected to minimize problems in marriage, including minimizing the divorce rate.Islam telah mensyariatkan perkawinan antara laki-laki dan perempuan dengan tujuan membina keluarga yang sakinah, mawaddah dan rahmah. Untuk mewujudkan perkawinan tersebut maka Islam telah menetapkan persyaratan kepada pasangan yang akan menikah untuk memiliki kemampuan menikah terlebih dahulu yang diistilahkan dengan istitā’ah al-bā’ah. Dalam praktiknya banyak yang memahami konsep istitā’ah al-bā’ah secara  parsial atau bahkan perkawinan yang tidak dilandasi konsep istitā’ah al-bā’ah. Kajian ini bertujuan untuk mengkaji konsep istitā’ah al-bā’ah sebagai sebuah persyaratan dalam perkawinan serta menjelaskan jenis dan kriterianya menurut perspektif syariah. Melalui kajian literatur (library research) terhadap kaidah fikih dan analisis kandungan terhadap kitab-kitab fikih. Analisis dilakukan secara mendalam terhadap data yang telah terkumpul. Kajian ini berhasil menemukan jenis-jenis dan kriteria kemampuan menikah yang dianjurkan dalam Islam, yaitu: pertama, kemampuan non material yang meliputi kemampuan melakukan hubungan kelamin, kesehatan fisik dari penyakit-penyakit yang berbahaya dan cukup umur. Kedua ialah kemampuan material yaitu kemampuan memenuhi biaya nikah yang terdiri dari kemampuan membayar mahar dan nafkah. Kajian ini berkontribusi dalam konteks penguatan standar kemampuan bagi pasangan yang ingin melangsungkan perkawinan. Sehingga dengan prasyarat kemampuan menikah tersebut, diharapkan dapat meminimalisir problem dalam perkawinan, termasuk meminimalisir angka perceraian.

This study has successfully found the types and criteria of marriage recommended in marriage, firstly, non-material abilities including an ability to have sex, physical health from dangerous diseases, and age. The second is material ability including an ability to meet the cost of marriage consisting of paying dowry and living. This study contributes to the context of strengthening the ability standards for couples wishing to get married. Therefore, fulfilling the requirements of the abilities to marry is expected to minimize problems in marriage, including minimizing the divorce rate.Islam telah mensyariatkan perkawinan antara laki-laki dan perempuan dengan tujuan membina keluarga yang sakinah, mawaddah dan rahmah. Untuk mewujudkan perkawinan tersebut maka Islam telah menetapkan persyaratan kepada pasangan yang akan menikah untuk memiliki kemampuan menikah terlebih dahulu yang diistilahkan dengan istitā’ah al-bā’ah. Dalam praktiknya banyak yang memahami konsep istitā’ah al-bā’ah secara  parsial atau bahkan perkawinan yang tidak dilandasi konsep istitā’ah al-bā’ah. Kajian ini bertujuan untuk mengkaji konsep istitā’ah al-bā’ah sebagai sebuah persyaratan dalam perkawinan serta menjelaskan jenis dan kriterianya menurut perspektif syariah. Melalui kajian literatur (library research) terhadap kaidah fikih dan analisis kandungan terhadap kitab-kitab fikih. Analisis dilakukan secara mendalam terhadap data yang telah terkumpul. Kajian ini berhasil menemukan jenis-jenis dan kriteria kemampuan menikah yang dianjurkan dalam Islam, yaitu: pertama, kemampuan non material yang meliputi kemampuan melakukan hubungan kelamin, kesehatan fisik dari penyakit-penyakit yang berbahaya dan cukup umur. Kedua ialah kemampuan material yaitu kemampuan memenuhi biaya nikah yang terdiri dari kemampuan membayar mahar dan nafkah. Kajian ini berkontribusi dalam konteks penguatan standar kemampuan bagi pasangan yang ingin melangsungkan perkawinan. This article discusses istinbāṭ (the way to absorb law from the main sources) of fiqh (Islamic law) by Tablighi students (santri) at Pesantren Temboro, Magetan, East Java in baḥth al-masā’il forum that is a forum for discussing Islamic law problems. The interesting thing of this study is Temboro Tablighi students as a traditionalist group known as the Islamic traditional community and the followers of Jamaah Tabligh. The questions are: What are the types of Islamic thought and the kinds of istinbāṭ used by Tablighi students? Is the istinbāṭ in the baḥth al-masā’il forum the same as that of other students of traditional Pesantrens in Indonesia or not? This article answers those research questions not only to analyze how Tablighi students apply the istinbāṭ model in their forum but also to analyze the baḥth al-masā’il products. This study is based on scoped library research i.e. the results of baḥth al-masā’il published in Tablighi students’ magazines during 2018, such as Al-Madinah, Al-Maktabah, Humairo, and Tranqil. One of the teachers involved in the forum is interviewed to clarify and get more detailed information. The results of the study show that the istinbāṭ method of Tablighi students, in general, is as same as other traditional students in other pesantrens which only apply qauliyyah method (using ulemas’ arguments written in classical books called Kitab Kuning). This study contributes significantly on how Tablighi santri of the Pesantren Temboro remain conserving a traditional scholarship knowledge (turats) with contextualization limitedly on some cases.Kajian ini mendiskusikan tentang istinbat hukum Islam atau fiqh dalam komunitas santri Tablighi di Pesantren Temboro, Magetan Jawa Timur dalam forum bahthul masail, forum yang mengkaji persoalan-persoalan hukum Islam. The Maslahat Epistemology in Cigarette Law: Study on The Fatwa Law on Cigarettes Between Sheikh Ihsan Jampes and The Majelis Tarjih of Muhammadiyah

Shaykh Ihsan Jampes gave the fatwa of the cigarette law as makrūh, while Majelis Tarjih gave the fatwa ḥarām. Although Sheikh Ihsan’s fatwa is individual, this fatwa deserves to be a comparison for the collective fatwa of the Majelis Tarjih. This is because the Sheikh Ihsan’s fatwa is a complete picture of the NU fatwa in general. This paper is based on two important questions, which the arguments are used by the two fatwas in formulating the cigarette law and whether there are conceptual differences from these arguments or not. To answer these two questions, the method used is descriptive-critical-analysis with a critical hermeneutic approach. This article finds that both fatwa of Sheikh Ihsan Jampes and Majelis Tarjih have the same argument in deciding the cigarette law, namely the argument of utility or usefulness (maşlaḥat). However, the two fatwas are different in formulating the maşlaḥat model used. Shaykh Ihsan used maşlaḥat taḥsīniyyāh while Majelis Tarjih put it in the shade of maşlaḥah darūriyyah. This article implies, not only from the various variants of the different choices of cigarette law but also providing insight into the epistemology that underlies these differences in law. This article educates smokers to choose between continuing or leaving smoking. Epistemology, as is well known, is the opening door to one's actions. This article also provides a perspective for policy-makers between legalizing or banning cigarettes based on the theory of maşlaḥat.Syeikh Ihsan Jampes memberi fatwa hukum rokok sebagai makrūh, sementara Majelis Tarjih memberi fatwa ḥarām. The Modus of Beggars in Lampung Urban Area : An Islamic Law Perspective 楠榜市区乞丐的行为方式:伊斯兰教法的视角

The poor and underprivileged are people who must be considered by the Government, but the reality at this time is that there are many poor and underprivileged people who become professions in the city of Bandar Lampung and Metro City, so it is necessary to review the existence and factors that influence it. This review is a field research (field research) conducted in Bandar Lampung City and Metro City; by describing data obtained through observation, in-depth interviews; the method used in analyzing is qualitative analysis presented descriptively; the aim is to find factors that drive the existence of beggars in urban areas, and the mode used by urban beggars. The focus of this paper is on the problems of career women both historically and juridical. This paper tries to reconcile the longstanding debate about the role of women in the public sphere. The stigma of women being identical to the domestic duties as servants of parents or servants of husbands has begun to change in the millennial era. Women have started going out and getting a profession in various fields. This study examines textually and historically related to women and juridical reviews in both classical jurisprudence and related to the Indonesian laws. This paper begins by analyzing the position of women historically, to analyze the development of women’s role in their life. While the juridical study by analyzing both the Marriage Law and the opinions of some fiqh experts and various other studies in accordance with the theme. This study provides the conclusion that there are career women who are challenges and at the same time opportunities to create a confident family. Progressive interpretation of career women seeks to produce fiqh in the middle way that women also have the right to do good deeds (work). But the right that given must still be based on the benefit of individuals and collectives (sakinah family).Fokus tulisan ini membicarakan tentang problematika wanita karier baik secara historis-yuridis. Tulisan ini berusaha mendamaikan perdebatan yang telah lama terjadi tentang peran wanita di ruang publik. Stigma wanita identik dengan tugas domestik sebagai pengabdi orang tua atau pelayan suami apabila telah menikah telah memulai pudar di era digital. Wanita sudah mulai keluar rumah dan mendapatkan profesi diberbagai bidang. Kajian ini dengan mengkaji secara tekstual baik yang terkait dengan historis wanita dan tinjauan yuridis  baik dalam fikih klasik dan Undang-undang Indonesia yang terkait. Tulisan ini dimulai dengan menganalisis kedudukan wanita secara historis untuk menganalisa perkembangan peran wanita dalam kehidupan. Sedangkan kajian yuridis dengan menganalisis baik dalam UU Perkawinan dan pendapat beberapa ahli fikih serta berbagai kajian lain yang sesuai dengan tema. Penelitian ini memberikan hasil kesimpulan bahwa ada wanita karier merupakan tantangan dan sekaligus peluang dalam menciptakan keluarga yang sakinah. Penafsiran progresif terhadap wanita karier berusaha menghasilkan fikih jalan tengah bahwa wanita juga berhak beramal kebaikan (bekerja). Namun hak yang diberikan ini tetap harus disandarkan kepada kemaslahatan individual maupun kolektif (keluarga sakinah).

The Reconstruction of The Modern Advertising Concept: An Islamic Law Perspective 伊斯兰法视野下的现代广告观念重构

Islam as a complete religion needs to offer a modern advertising concept to reconstruct the existing advertising concept which tends to be value-free so that it has the potential to cause  negative impact on the consumer society. The purpose of this study is to reconstruct the concept of modern advertising using the perspective of Islamic law to serve as an alternative guidance for more Islamic advertising practices. To achieve this goal, the author uses the methods of normative legal research  with the conceptual approach.  The results of this research conclude that the Islamic legal concept of advertising requires fulfillment of the elements and requirements of advertising contract (arkân wa syurūth al-i’lân)  to ensure that the advertiser (al-mu'lin) , the object advertised (al-mu'lân) ,the advertising media (wasilah al-i'lân) and  the recipient of the advertisement (al-mu'lan lahu) do not conflict with Sharia principles.  A producer/ seller can deliver advertising on a product either directly or through advertising media. The use of advertising media can involve the role of humans and/ or other supporting facilities such as writing, posters/ pictures, and musical instruments. The contract that underlies the advertising agreement between the sponsor and the advertising service provider is the agreement to give authority with a wage system (wakâlah bi al-‘ujrah). Islam sebagai agama paripurna perlu menawarkan konsep periklanan modern untuk merekonstruksi konsep periklanan  yang selama ini cendrung bebas nilai  sehingga berpotensi menimbulkan dampak negatif bagi masyarakat konsumen.  Tujuan penelitian ini adalah untuk merekonstruksi konsep periklanan modern menggunakan perspektif hukum Islam untuk dijadikan sebagai pedoman alternatif praktik periklanan yang lebih islami. Untuk mencapai tujuan tersebut, penulis menggunakan metode  penelitian hukum normatif dengan pendekatan konseptual. Dari  hasil penelitian dapat disimpulkan  bahwa suatu konsel hukum  periklanan  yang islami mensyaratkan terpenuhinya rukun dan syarat-syarat iklan untuk memastikan agar  pengiklan (al-mu’lin) , objek yang diiklankan (al-mu’lān) , media iklan (wasilah al-i’lān) dan penerima iklan (al-mu’lin lahu) tidak bertentangan dengan prinsip-prinsip syariah. Seorang produsen/ penjual dapat menyampaikan iklan  suatu produk baik secara langsung atau melalui media periklanan.  Penggunaan media iklan dapat melibatkan peran manusia dan/ atau sarana pendukung lainnya seperti tulisan, poster/ gambar, dan instrumen musik. Adapun akad yang mendasari  perjanjian periklanan antara sponsor dengan penyedia  jasa iklan adalah   perjanjian pemberikan  kuasa dengan sistem upah (wakālah bi al-‘ujrah) .
