Komparasi Hukuman Pidana Masyarakat Pinggiran dalam Perspektif Hukum Positif dan Hukum Islam 用积极的法律和伊斯兰法来比较郊区的刑法

Abstract Islamic law strongly holds the principles of fairness in deciding a case. As the author described above that the person who stole because of compulsion or for fulfilling his life there is no punishment for him. Because the above cases are small cases that befall the people whose notables are not economically capable. Then what should be done to those fringe peoples? In the context of Islam, if they can not meet the daily needs (needs to eat or continue to live) then they will be dependent on the Baitul Maal or other languages that are responsible for themselves by following article 34 UUD 45 is poor and the displaced children are maintained by the state. This article will present a point of view on some criminal cases above from two different laws, namely Islamic law and the law in Indonesia.

Konsep Pemikiran Ibn Taymiyah Tentang Kepemimpinan Politik Dalam Islam

Abstract Ibn Taymiyah's thoughts on political leadership in Islam include the form of leadership, the requirements of a leader, and the electoral procedures of the leader. Also Besides, what are the differences and similarities and the advantages and disadvantages of political leadership from the viewpoint of political philosophy?. The research data is compiled through text reading and study (text reading) and subsequently analyzed by the approach of political philosophy, descriptive method, comparative and content analysis. The results of the study concluded in Ibn Taymiyah's thought, leadership forms tended to maintain the status quo of the autocracy kingdom, the requirements of the leader were people who had strengths (quwwah) and Integrity (trust), and leaders Elected or shadowed by Ahl-Shawkah, but it does not explain in detail how the institution was formed and how it was chosen. Ibn Taymiyah did not use the term imamate or caliphate in leadership, not requiring the leader to be of the tribe of Quraish, emphasized the importance of deliberation and alluded to the figure of Fir'aun and Qarun as the disgraceful man. Ibn Taymiyah's thought lies in the guidance to elect state officials, there should be a harmony between the leader and his deputy, the terms of strength (quwwah) and Integrity (trust), these terms are the same as that of Plato, the self-control, wisdom, courage, and justice.

Abstract Ministry of Religious initiatives to implement the program in accordance with the regulations issued by the Director-General of Islamic Community guidance of the Department of Religious candidates for the No. DJ. II/491 Year 2009. Therefore, the quality of a marriage is determined by the readiness and maturity of the two prospective spouses to meet the life of the household in order to form a harmonious family in accordance with the premarital ideals. The research uses Research and Development (R&D) methods by combining qualitative and quantitative research. Qualitative data is obtained through verbal and written interview results. The problems that occur in the community that the effectiveness of the prospective bride course has not walked fully well, with a variety of factors that inhibit, so that the bride who has not understood the whole material about the concept of family Sakinah that has been poured in the course process Bride brides. For that, the research seeks to uncover the implementation of the bride candidate course at the Office of Religious Affairs (KUA) of Papar District of Kediri, as well as how the prospective bride understanding the family concept of Sakinah.

Abstract Basically, corruption has a bad impact on the whole joints of human life. Corruption is one of the major causal factors of justice and prosperity of a nation. Corruption also adversely affects the economic system, democracy system, political system, legal system, governmental system, and societal order. No less important corruption can also degrade a nation in international governance. Therefore, we should put corruption as a common enemy that we have to fight together because of its extraordinary nature, then to combat or eradicate corruption is needed extraordinary effort anyway. The effort to eradicate corruption is not at all an easy job. The eradicating corruption effort can not only be the responsibility of law enforcement institutions or government only, but also a responsibility with all the components of the nation. Therefore, the efforts to eradicate corruption should involve all stakeholders that are related, namely government, private and community. It is in this context that students, as one of the important parts of the community, are expected to be active. earnestly. The important contribution of students in the prevention of corruption can not be released from the characteristics they possess, namely: intellectuality, Young Soul, and idealism. Student involvement in the anti-corruption movement can essentially be differentiated into four regions, namely: in the family environment, in the campus environment, in the local community, and at the regional or national level.

Abstract The development of the IPTEK (Science and Technology) world has brought tremendous benefits for the advancement of human civilization. The types of work that previously demanded considerable physical capability, are now relatively can be replaced by automatic machine devices. The working system that has been over-enabling human energy with the science and sophistication of technology is amazing. The civilization of the nation and the world society in the future is understood and realized will be faced with the complex situation in various branches of science. Therefore, to power, the IPTEK is required lofty values to be accountable. The debate that IPTEK's contributions with the development of an area the Islamic economic system is still ongoing. This is due to the absence of a theory, research, or model that can explain the relationship between the two factors above. It takes a test using a valid method to generate an accurate conclusion on the development and contribution of IPTEK applications with the development of the Islamic economic system. Nevertheless, some communities still believe that IPTEK's contributions to the development of the Islamic economic system of a particular region.

Pemasaran Syariah dalam Upaya Optimalisasi Peran Lembaga Amil Zakat di Indonesia 伊斯兰营销是为了优化阿米尔·扎卡特在印尼的作用

Abstract The purpose of this research is to know the role of Sharia marketing strategy in supporting the role of Lembaga Amil Zakat especially in the optimization of fundraising Zakat, Infaq, charity, and Waqaf (ZISWAF) from the community. The research uses a library research approach. Indonesia has a vast number of people and the majority are Muslims. Nevertheless, there are still some communities that are still under the poverty line which is about 9.66% of the total number of Indonesian people in 2018 as many as 265 million people. The role of Lembaga Amil Zakat (LAZ) in optimizing the collection and management of funds (ZISWAF) is expected to suppress the poverty rate. But in practice still, lack of knowledge and public awareness in fulfilling its obligation to pay zakat. Most of the community considers that zakat must be paid annually is Zakat Fitrah, while Zakat mal (treasure) is not mandatory. Therefore the necessity of proper marketing strategy and by following the mission-vision of the Institute of Amil Zakat (LAZ) should be applied. The institution of Amil Zakat can conduct sharia marketing strategy, namely implementing the process segmenting, targeting, positioning in their marketing and framed in a product that is suitable Islamic sharia. The introduction or socialization of the products of the Amil Zakat institution must be on target and can reach all walks of life quickly. Therefore, the use of technology is also needed to accelerate the socialization, expanding the reach, and supporting the concept of transparency so that the belief in the Society of Amil Zakat can increase.

Penerapan Etika Bisnis Terhadap Kepuasan Konsumen dalam pandangan Islam 从伊斯兰教的角度来看,商业道德对消费者满意度的应用

Abstract Increased economic growth has led to higher public incomes and ultimately has been the driver of growth in household consumption. So that causes public consumption of goods and services also increases. Given the high level of consumption, and in order to increase corporate income, and increase customer satisfaction, Business Ethics plays a very important role. Profit is not the only object sought by business people. Besides profits, business people need to realize customer satisfaction. Where consumer satisfaction is also one indicator measuring how much the company cares about consumers, so it does not lead to the notion that the company is selfish, and only has the purpose of making profits without thinking about consumer welfare and satisfaction. Islam teaches that we be fair, and are mutually beneficial (help). Therefore, we are encouraged to have an attitude and ethics in doing business, so that not only we feel profitable, but also the consumers. So that after consuming our products, the consumer feels that the products and prices we make and distribute are balanced with the quality and function of the product.

Zakat adalah salah satu dari rukun Islam yang wajib dipenuhi oleh setiap muslim serta pelaksanaan dan perwujudan zakat merupakan tugas dan tanggung jawab kita bersama. Zakat menjadi wujud ibadah seseorang kepada Allah sekaligus dan sebagai perwujudan dari kepedulian social (ibadah sosial). Zakat juga merupakan kekuatan besar umat yang sampai saat ini belum termaksimalkan, pada beberapa kasus telah menjadi penyebab yang mengkwatirkankan. Hal itu terjadi karena ketidaktahuan masyarakat mengenai zakat, juga tidak mengetahui bahwa di dalam Al-Qur’an dan hadits telah diwajibkan menunaikan zakat.Sebagai bentuk perhatian dan usaha pemerintah dalam mengelola zakat di Indonesia, maka pelaksanaan pengelolaan zakat diatur dalam UU. No. 38 tahun 1999 tentang pengelolaan Zakat dan UU RI No. 21 Tahun 2008 tentang Perbankan Syariah sebagai lembaga yang menerima dana dari zakat, infak, sedekah, hibah atau dana sosial lainnya dan menyalurkannya kepada organisasi pengelola zakat.Deposito merupakan salah satu sarana investasi yang disediakan oleh bank yang paling diminati oleh sebagian besar masyarakat. Namun, deposito yang menggunakan sistem bunga dilarang dalam hukum Islam karena mengandung unsur ribawi. Deposito yang sesuai dengan syariah adalah deposito yang berdasarkah prinsip mudharabah.Melakukan sistem pengelolaan zakat secara otomatis pada tabungan deposito kepada deposan memang tidak salah karena merupakan harta yang berkembang, namun dalam sistem pengelolaannya harus sesuai dengan kaidah-kaidah hukum Islam. Karena perbankan syariah dalam melakukan kegiatan usahanya berdasarkan prinsip syariah, demokrasi ekonomi dan prinsip kehati-hatian.
