Results: the methodological significance of the practice in the empirical basis of civilized research and the need for a non-109 formal approach to the design of the content of the “empirical base” section, as an essential element of the theological method of the dissertation, are proved. Attention is drawn to the methodological value of socially entrepreneurial law-making and law-enforcement experience of mission-driven corporations, namely, that this practice should be considered as an empirical basis: a) the formation of a new theoretical legal model of corporate governance, as an alternative to the dominant shareholder-driven model; b) substantiation of recommendations on the legalization of the Russian legal form of a corporate entity capable of adequately responding to the challenges of the digital economy. With this approach, a new model of corporate governance becomes not a means of providing profit for its shareholders, but a legal tool protecting the leadership of a corporation aimed at achieving the success of a social, scientific, environmental mission. This advantage gained by top management of a socially useful corporation allows it not to chase profits at any cost, but to focus on the implementation of the mission, which necessitates and the possibility of investing in human capital – the company’s main competitive advantage in the digital economy.

Results: on the basis of approaches, principles and rules developed by the doctrine of comparison, a “roadmap” was defined for using the comparative legal method in thesis works: formulation of purpose of addressing the foreign experience of legal regulation; choosing the legal system for comparison; understanding the contents of the foreign law norms; discovering similarities and differences in legal regulation; comments, critical examination and execution of the results obtained from comparison.

Introduction: the article is devoted to the assessment of the prospects for the implementation of the methodological potential of social entrepreneurship in the civil study of the legal regulation of entrepreneurial activity in the field of funeral services. The purpose of the work is to assess the possibilities of the ideology of social entrepreneurship as a methodological basis for the study of legal regulation of entrepreneurial activity in the field of funeral services. Methods: empirical methods of comparison, interpretation, generalization; theoretical methods of formal and dialectical logic. Private scientific methods were applied: formal-legal and legal-dogmatic. Results : it consists in the development of a new idea about the demand for the methodological potential of the anti-crisis ideology of social entrepreneurship (ideas, principles, approaches) in the study of Russian and foreign processes and changes occurring in burial and funeral activities, as well as in forecasting the development of the mechanism of legal regulation of market relations in the field of funeral services in Russia. Conclusions: the author proves the relevance of the ideology of social entrepreneurship as a methodological vector, the core, the initial theoretical position that provides the formulation of scientific research tasks and, accordingly, the architect of the concept of legal regulation of entrepreneurial activity in the field of funeral services, which allows to fundamentally change the approach to the reform of the current Federal law on burial and funeral business.
