The 2 nd Africa Animal Welfare Conference was held on 3 rd to 5 th September 2018 at the United Nations Environment Complex in Nairobi, Kenya. The event, which is an annual one, is organized by the Africa Network for Animal Welfare (ANAW) and is co-hosted by the United Nations Environment and the Government of Kenya. It provides a unique opportunity for relevant stakeholders (including veterinarians, NGOs, lawyers, farmers, judges, government, professionals and others) to come together and engage on topics relating to animal welfare, wildlife, environmental conservation and humans. This year, the Conference featured the “Africa Animal Law Convention” held concurrently on the second and third days of the Conference, sponsored and organized by the Center for Animal Law Studies at Lewis & Clark Law School (based in Portland, Oregon, U.S.A). This was the first of its kind event held in Africa and featured animal law experts from the continent as well as the U.S.A and Europe, who presented on myriad subjects relating to the interaction between animals and the legal system. The theme for this year’s conference was “ People, Animals and The Planet: One Health, One Welfare”, emphasizing the interconnectedness of these three pillars; the necessity to consider them in combination; and the call to utilize knowledge and skills to generate and implement homegrown solutions.

This article aims to analyze the effectiveness of animal welfare certification for compliance with the legal prohibition of cruelty and mistreatment in the egg industry. I analyze the conditions of conventional cage systems, the legal protection to laying hens in Brazil, and the animal welfare certification for laying hens. I conclude that the existing welfare certification for laying hens is enough to ensure the accomplishment of the law, but it is necessary to consider ways to stimulate producers to obtain this certification and, therefore, to change their mode of production, providing a high level of welfare for laying hens.

The debate on the notion of the person and its importance for the Law is one of the most passionate of recent years. The fact that the synonymy of the person and the human being has for centuries been accepted without a shred of a doubt is largely related to the formation of legal systems in the western world and their transposition of decidedly anthropocentric categories. However, the gradual widening of these categories to incorporate new ideas and social demands has vigorously awoken the questions surrounding the notion of the person and of legal personality and its possible extension to animals also. Reflections that contribute to this debate will here be presented, briefly and without prejudice.

Last July the first summer course in Animal Law took place at Aarhus University, Scandinavia, one of Europe’s most renowned universities. The course was created and lectured by Sacha Lucassen (MA Animal Law and Society, UAB - 5th Edition) and welcomed students not only from all over Europe, but even from Vietnam, Kenya, China and Australia. It revolved around the main question “How and to what extend are – or should - animals be protected by the law?” Experts in different domains within the scope of Animal Law delivered valuable contributions to the course during several guest lecturers. The course put Animal Law on the academic program in Denmark and will take place again next summer.

However, the thoughts of people and the authorities have for a while been shifting towards an understanding that a modern States must abandon any type of violent or unnatural practice that aims to entertain, as has occurred with the use of animals in circuses. However, the Tauromaquia has resisted this change, as well as the constitutional decisions in its favour. So, it remains to be seen how the contradictory decisions of the Court have “jeopardised” the protectionist future that in 2017 began to be envisaged for animals, so the absence of legal security in Colombia could revive this bloody practice.
