Based on the alterations of new scientific paradigms that sustain the demand for a relationship between humans and non-human animals founded on bioethics, this paper seeks to highlight the urgency in the creation of a new legal status for animals in Brazil, and the need of relocating Animal Law as an autonomous academic discipline.

Se estudian paises con regulacion constitucional y otros que no la tienen, sin perjuicio de un reconocimiento legislativo o jurisprudencial. EnglishThis is a systematic contribution on the constitutional right of animal welfare. The comparative law and the relation with phenomena such as the objection of conscience, the annulment of the acts contrary to the animal welfare or the interpretation of the fundamental rights when there is an affectation to the treatment with animals are analyzed. Countries with constitutional regulation and others that do not have it are treated without prejudice to legislative or jurisprudential recognition.
