In article the genesis and development of the theory about the rights and freedoms of a person are studied. Works of classics and modern scientists about the reasons of their emergence, about justification of giving to the rights and freedoms of natural character are analyzed. Features of formation and evolution of the natural-legal theory in Russia are investigated. Negative consequences of denial of the theory during the Soviet period and her positive influence on process of democratization of the Russian society during the postsoviet period are noted. The problem of a ratio of the natural right with positive law, their influence at each other, completeness of legal fixing of the rights and freedoms of the person is solved. The changes in the theory about natural human rights which have arisen under the influence of process of historical development of society are considered. As a result of a research the author comes to a conclusion about a positive role of the theory about the natural rights and freedoms of the person in general and also about her positive influence on modern science of constitutional right and law-making.

The article considers the legal nature of the legal precedent that has become relevant recently – the transfer of maintenance obligations by inheritance. As a general rule, enshrined in the civil law doctrine of our country, property rights and obligations are not part of the inheritance, if they are inextricably linked with the personality of the testator, and also if their transfer in the order of inheritance is not allowed by the Civil Code of the Russian Federation or other federal laws. In particular, the inheritance does not include the right to alimony and maintenance obligations. However, the judicial practice of the Supreme Court of the Russian Federation, which has arisen since 2013, suggests the opposite: the monetary obligation in question was recognized as a debt unrelated to the person, and therefore, according to the court, the obligation to pay it must pass to the heir of the debtor, which the latter subject to acceptance of the inheritance, he is obliged to repay within the limits of the value of the inherited property transferred to him. The article expresses the author's reasoned opinion on the controversy of such a position.

Аннотация. В статье раскрывается содержание предмета преступления, предусмотренного ст. 258.1 УК РФ. Обращается внимание на необходимость уточнения критериев отбора объектов животного мира при формировании перечня особо ценных диких животных и водных биологических ресурсов, принадлежащих к видам, занесенным в Красную книгу Российской Федерации и (или) охраняемым международными договорами Российской Федерации. Дается рекомендация по дополнению перечня особо ценных диких животных и водных биологических ресурсов, охраняемых нормами ст. 258.1 УК РФ. Annotation. The article reveals the content of the subject of the crime provided by article 258.1 of the Russian Criminal code. Attention is drawn to the need to clarify the criteria for the selection of wildlife for the list of particularly valuable wild animals and aquatic biological resources belonging to the species included in the Red List of Threatened Species of the Russian Federation and (or) protected by international treaties of the Russian Federation. The article contains recommendation for supplementing the list of especially valuable wild animals and aquatic biological resources protected by norms of Article 258.1 of the Russian Criminal code.
