When the accident is a mystery — when it is not clear what happened — courts often rely on stacked inferences. Such inferences are subject to much debate and are even prohibited by some jurisdictions. This Article reveals that the doctrine of res ipsa loquitur (“the thing speaks for itself”) is a form of stacked inferences and that despite its affiliation, it has been widely accepted. The Article further shows that application of res ipsa loquitur in cases involving multiple actors can adversely affect precaution and activity levels. It concludes with a call for a careful application of res ipsa loquitur in cases involving multiple actors.

We examine theoretically and experimentally the implications of trust arising under sequential and simultaneous designs, where one player makes an investment choice, and another player decides whether to share the investment gains. We show analytically that in some cases the sequential design may be outperformed by the simultaneous design. In an experiment we find that the investment levels and sharing rates are higher in the sequential design, but there are no corresponding differences in beliefs. We conjecture that this happens because in the sequential design substantially more trust is necessary to induce cooperation. Our data strongly support this conjecture.

The paper examines the claim that a virtuous cycle of more secure land rights, more land-saving investments, and denser populations requires the development of institutions that regulate competition over land. We construct a contest model that links the tenure-security-investment relationship to the efforts of land users to enhance land rights themselves and the role of institutional protection. We study the effect of population growth on a close-to-subsistence economy, including the possibility that it weakens institutional protection. We derive sufficient conditions for a positive effect on land investment, but also show that population growth can push the economy into a low-productivity trap.
