As part of its coverage on the human resource issues that will face hospital managers in the next few years, FAHS Review interviewed several of the investor-owned industry's most outspoken and respected, managers. Although the comments of these five executives range from a call for a complete overhaul of the administrative functions of the hospital to the early recruitment of young people into the health care industry, all agreed on one key point: the successful hospital manager of the 1990s will have to be savvy, tough, resourceful, flexible and innovative.

In the past two years there has been a significant increase in the number and variety of hospital medical staff cases decided by the courts. The issues range from whether medical staff bylaws constitute a contract with individual medical staff members, the legal opportunity to assert employment discrimination claims in medical staff disciplinary proceedings, and ongoing antitrust concerns. This article presents an overview of the recent litigation related to these subjects.
