Shen Congwen’s Border Town as an example of heterotopia of compensation The concept of heterotopia of compensation created by Michel Foucault with reference to spaces occurring in the real world is also useful in the analysis of literary works. The world depicted in the novella Border Town by Chinese writer Shen Congwen exhibits model features of the heterotopia of compensation. All the elements that make up the presented world – nature, the town, the protagonists or their behavior – are ideal, beautiful, harmonious, and noble. Border Town is a creation of a reality different from the reality surrounding the writer and reflects the typical views among Han nationalities about national minorities as backward and poor, but at the same time living in harmony with nature and cultivating the traditions of the past.

Democratic People’s Republic of Korea: A nuclear power In recent years, we have seen a deterioration of the security environment in the Asian region. This situation is mainly influenced by the political, economic, and military rivalry among states. Countries that have nuclear weapons in their arsenals play important roles in the security system. Of the nine countries with nuclear weapons, four are in Asia. Along with increasing their nuclear capabilities, these states are also revising their war doctrines, often moving away from deterrence strategies and envisaging the use of nuclear weapons as a means of first strike. North Korea has made significant progress over the past two decades in developing its nuclear weapons arsenal, including means of delivery. It has conducted six nuclear tests and tested a number of new ballistic missiles, several of which can hit targets in Northeast Asia and potentially in the United States and Europe. It is estimated that North Korea could potentially produce 20 to 30 warheads to be delivered mainly by medium and short-range ballistic missiles. In September 2022, North Korea announced it would respond to attacks on its nuclear command and control systems by launching a nuclear attack “automatically and immediately.”

Reżim prawny ochrony dziedzictwa kultury w Indiach Uprawnienia do stanowienia praw dotyczących ochrony dziedzictwa kultury w Indiach są podzielone między parlament i stanowe ciała ustawodawcze na mocy Konstytucji Indii. Chociaż Indie mają wiele obiektów historycznych, pomników i tradycji kulturowych, twórcy Konstytucji Indii położyli większy nacisk na ochronę mniejszości, ich praw kulturowych i języków. W rezultacie istnieją pewne prawa podstawowe, które gwarantują ochronę osobom mającym „odmienny język, pismo lub kulturę”, dając im prawo do ich zachowania. Istnieją również podstawowe obowiązki, zgodnie z którymi każdy obywatel musi m.in. dbać o bogate dziedzictwo kultury Indii i chronić je. Archeologiczny aspekt indyjskiego dziedzictwa kultury wywodzi się od Brytyjczyków. Pierwsze prawa dotyczące ochrony dziedzictwa były kolonialne, a niektóre z nich nadal obowiązują. Prawa ustanowione w niepodległych Indiach również zawierają te same podstawy. Jeśli chodzi o egzekwowanie przepisów, Indie dobrze sobie radzą, odzyskując swoje zabytki, które zostały skradzione i przemycone za granicę. Legal measures to protect fashion design in the People’s Republic of China This article aims, first, to present means of protecting fashion design offered by intellectual property law in the People’s Republic of China. The author briefly discusses the intellectual property law system in China, detailing the instruments that help protect fashion designs. Second, examples show how the protection mechanisms of intellectual property rights are applied in practice. The author also briefly describes the characteristics of the fashion industry as a specific market and the potential threats to it.

Koreańska regulacja Shutdown Law (셧다운제), a problematyka korzystania z gier elektronicznych i mediów społecznościowych przez małoletnich Dotychczas w literaturze przedmiotu, a w szczególności w naukach prawnych, brakowało badań, które w sposób szeroki objęłyby problematykę korzystania z gier elektronicznych i mediów społecznościowych przez małoletnich. W artykule postawiono tezę, że współczesne ustawodawstwa powinny wprowadzać odpowiednie mechanizmy prawne przeciwdziałające negatywnym skutkom nieprawidłowego korzystania z gier elektronicznych i mediów społecznościowych przez małoletnich. W pierwszej części artykułu zarysowany został problem badawczy, w tym negatywne skutki nieprawidłowego korzystania ze wskazanych wytworów technologii przez małoletnich, a także przytoczono obszerne dane statystyczne na ten temat. W drugiej części wskazano możliwe działania polityczne i legislacyjne oraz regulacje prawne, które zmierzają do zapewnienia odpowiedniej ochrony małoletnim w kontekście opisanych zagrożeń. Ze względu na nasilony stopień ingerencji ustawodawczej uwaga została poświęcona w znacznej mierze porządkom prawnym regionu Azji Wschodniej, a w szczególności Korei Południowej. Na ostatnią część artykułu złożyła się szczegółowa analiza koreańskiego unormowania ograniczającego dostęp do gier przez małoletnich, z wyróżnieniem regulacji Shutdown Law (셧다운제), która to funkcjonowała przez ponad 10 lat, do 2021 r. Legal aspects of genomics research and biobanking in the East Asia region The contemporary development of science and technology in the field of biomedicine has influenced the development of innovative research tools in modern diagnostics and therapies. Many Asian countries are currently interested in genetic research and biobanks, in response to increasing competitiveness on the global biotechnology market. Establishing of a modern research infrastructure in China, Japan, and South Korea is essential for future research on the etiology of genetic diseases and the development of effective methods of their treatment. Undertaking concerted legislative work is a response to numerous challenges related to the collection, processing, and sharing of biological material and related genetic information. The main problems in the field of genetic research and biobanks are the concept of informed consent, the protection of genetic data, and the commercialization of genetic material. Bio-law in China, Japan, and South Korea is the result of the search for consensus between protecting the fundamental rights of individuals and the freedom of research.

Blood commodification in selected works of Chinese contemporary literature based on Chronicle of a Blood Merchant by Yu Hua and Dream of Ding Village by Yan Lianke Narratives that touch upon the topic of physical disease have had a long-standing presence in Chinese literature. In many examples, such narratives serve to present certain abnormal conditions in society. The AIDS epidemic, which erupted in rural China in the 1990s – an event both recorded and officially acknowledged – is an example of such a horrific real-life event depicted in literary works. Blood-selling, which is known to be the direct cause of the tragedy, also became the starting point for two Chinese novels, both translated into major languages: Chronicle of a Blood Merchant by Yu Hua and Dream of Ding Village by Yan Lianke. Even though both novels present clear links to the AIDS epidemic, their content and form elicited contrasting reactions in China. This article presents metaphorical interpretations of how blood-selling is depicted in the novels. The comparison of these two helps to better understand the near opposite reception of the works. Furthermore, the proposed notion of commodification reveals the impermanence of the traditional mindset once a chance to improve the economic situation appears.

Blood-selling, which is known to be the direct cause of the tragedy, also became the starting point for two Chinese novels, both translated into major languages: Chronicle of a Blood Merchant by Yu Hua and Dream of Ding Village by Yan Lianke. Even though both novels present clear links to the AIDS epidemic, their content and form elicited contrasting reactions in China. This article presents metaphorical interpretations of how blood-selling is depicted in the novels. The comparison of these two helps to better understand the near opposite reception of the works.
