The sale of another person property mainly concerns the civil law and literature. However, there are some criminal offences built on the basis of such operation, made without the owner’s consent. The study analyses, in the first part, the criminal offences which are concerned and the potential justifying causes. We will thus study the breach of trust, fraudulent management, embezzlements, fraud and, from a certain point of view, theft. The main justifying causes which could be claimed are the performance of a right and state of necessity. Since the sale of another person’s property does not concern only the criminal law, the second part of the study will be dedicated to the consequences within criminal procedure, showing the place of the initial owner and that of the person who bought the asset.

Lawyers should be expert communicators, most of their drafting requiring preciseness and efficient phrasing. However, in practice, legal writing is rarely conveying the information effectively, regardless its importance: from contracts to legislation, from legal literature to documents submitted in courts one may find imprecise, pompous, leaden legal language. Oddly enough, the inadequacies traverse legal systems, languages and cultures, the critique being uniformly applicable around the world. This study follows the legal writing tradition and advocates the simplification and accessibility of this language.

The property right is guaranteed by the Romanian Constitution and by the international conventions, especially by the European Convention of Human Rights. Concretely, the Civil Code protects the property right. In a subsidiary manner, after the constitutional, conventional and civil law, the criminal law also ensures the protection of property. One cannot offer a universally available solution with respect to the interpretation as a crediting activity of any given sales contract with the payment of the price in installments and reservation of property. The solution offered by the National Bank of Romania [as the only authority able to decide with respect to the crediting nature of an entity’s activity falling under Law no. 93/2009, article 3 paragraph (1)], following the analysis of each individual case by filtering the criteria explicitly set by the legislator through the provisions of art. 3 of Law no. 93/2009 parag. (2) final thesis – is their pursuit as stand-alone economic activities, aimed at obtaining regular income, as well as boasting the existence of internal structures specialized in crediting that manage and analyze these activities separately on the basis of predefined rules and by taking into account crediting activities when designing the company's budget or making forecasts regarding the overall activity of the company, which will be the subject of this analysis.

"The present article has the goal of studying the modalities in which the subjective connection is formed between the legal entities and natural persons who act on their interest, main activity or in their name. The analysis is based on a classification between the natural persons who can hold the legal entities criminally liable, respectively the decision-makers and the executants. The decision-makers are the ones who dictate the direction of the legal entity and form its will, while the executants are the persons who do not have any decision-making power, but whose action is capable of holding the legal entities criminally liable. In addition, another distinction that is used in this analysis is the one between the subjective and objective stage in which the guilt and the criminal liability of the legal entity is formed. Starting from these discussions, the analysis is performed in a structured way, in which the interactions between natural persons and legal entities are verified, problems are proposed for discussions and, on some occasions, solutions are proposed related to which guilt forms and participation forms could be incident. Finally, a general proposal of regulation is included for the problem of the criminal participation of legal entities, but only as a step subsequent to a constant jurisprudence in the matter, in which is also analysed the form of participation of the convicted legal entities, as well as subsequent to the extensive analysis, by the legal literature, of the criminal law specific problems related to the dynamics of the relationship between legal entities and natural persons."

Indiferent de modul în care s-a dezvoltat, model jurisprudențial sau model legislativ, standardul de probă a avut ca scop asigurarea unei proceduri echitabile în materie penală. Concluziile celor două modalități de evoluție standardului de probă arată însă că evaluarea vinovăției are reguli similare, de natură să susțină aplicarea unitară a legii și eliminarea discriminării, indiferent de locul săvârșirii infracțiunii.

Under the Romanian legal system there are no specific regulations concerning transsexualism, nor are clear medical, administrative or judicial procedures configured. However, without any doubt, the medical transition to the gender with which a trans person identifies him/herself is allowed, as well as the legal recognition of the new sexual identity. If a trans person obtained a favourable judicial decision, based on which the necessary changes have been made in the civil status acts, being issued a new identity card, then, in principle that person can prevail him/herself of the legal consequences of his/her new identity, in all areas of social life. Regarding the coverage by the public health insurance system of treatments and operations for gender reattribution, there is no convergent point of view of competent institutions.
